TheDecisionoftheStandingCommitteeoftheNationalPeople'sCongressonAmendingtheCopyrightLawofthePeople'sRepublicofChinawasadoptedatthe13thmeetingofthe11thStandingCommitteeoftheNationalPeople'sCongressofthePeople'sRepublicofChinaonFebruary26,2010.ItisherebypromulgatedandshallcomeintoeffectonApril1,2010.ChinesePresidentHuJintaoFebruary26,2010CopyrightLawofthePeople'sRepublicofChina(passedatthe15thmeetingoftheStandingCommitteeoftheSeventhNationalPeople'sCongressonSeptember7,1990,revisedforthefirsttimeaccordingtotheDecisiononAmendingtheCopyrightLawofthePeople'sRepublicofChinaatthe24thmeetingoftheStandingCommitteeoftheNinthNationalPeople'sCongressonOctober27,2001,andrevisedforthesecondtimeaccordingtotheDecisiononAmendingtheCopyrightLawofthePeople'sRepublicofChinaatthe13thmeetingoftheStandingCommitteeoftheEleventhNationalPeople'sCongressonFebruary26,2010)CatalogChapter1GeneralProvisionsChapter2CopyrightSection1CopyrightOwnersandTheirRightsSection2OwnershipofCopyrightSection3ProtectionPeriodofRightsSection4LimitationsonRightsChapter3CopyrightLicenseandTransferContractChapter4Publication,Performance,AudioandVideoRecording,andBroadcastingSection1PublicationofBooksandNewspapersSection2PerformanceSection3AudioandVideoRecordingSection4BroadcastingbyRadioandTelevisionStationsChapter5LegalResponsibilitiesandEnforcementMeasuresChapter6SupplementaryProvisionsChapter1GeneralProvisionsArticle1:Inordertoprotectthecopyrightofauthorsofliterary,artistic,andscientificworks,aswellastherightsandinterestsrelatedtocopyright,encouragethecreationanddisseminationofworksthatarebeneficialtotheconstructionofsocialistspiritualandmaterialcivilization,andpromotethedevelopmentandprosperityofsocialistcultureandscience,thisLawisformulatedinaccordancewiththeConstitution.Article2:WorksofChinesecitizens,legalpersonsorotherorganizations,whetherpublishedornot,shallenjoycopyrightinaccordancewiththisLaw.ThecopyrightenjoyedbyforeignersandstatelesspersonsintheirworksbasedonagreementssignedbetweentheircountryoforiginorhabitualresidenceandChina,orinternationaltreatiesjointlyparticipatedin,isprotectedbythisLaw.ForeignersandstatelesspersonswhoseworksarefirstpublishedwithintheterritoryofChinashallenjoycopyrightinaccordancewiththisLaw.AuthorsfromcountriesthathavenotsignedagreementswithChinaorjointlyparticipatedininternationaltreaties,aswellasworksofstatelesspersonspublishedforthefirsttimeinamemberstateofaninternationaltreatytowhichChinaisaparty,orpublishedsimultaneouslyinbothmemberandnonmemberstates,areprotectedbythislaw.Article3:TheworksreferredtointhisLawincludeliterary,artistic,naturalscience,socialscience,engineeringandtechnicalworkscreatedinthefollowingforms:(1)Writtenworks;(2)Oralworks;(3)Music,drama,folkart,dance,andacrobaticworksofart;(4)Artworksandarchitecturalworks;(5)Photographicworks;(6)Filmworksandworkscreatedusingmethodssimilartofilmproduction;(7)Engineeringdesigndrawings,productdesigndrawings,maps,schematicdiagramsandothergraphicworksandmodelworks;(8)Computersoftware;(9)Otherworksasstipulatedbylawsandadministrativeregulations.Article4:CopyrightownersshallexercisetheircopyrightwithoutviolatingtheConstitutionandlaws,andwithoutharmingpublicinterests.Thestatesupervisesandmanagesthepublicationanddisseminationofworksinaccordancewiththelaw.Article5:Thislawdoesnotapplyto:(1)Laws,regulations,resolutions,decisions,ordersofstateorgans,andotherdocumentswithlegislative,administrative,andjudicialnature,aswellastheirofficialtranslations;(2)Currentaffairsnews;(3)Calendar,universalnumbertables,universaltables,andformulas.Article6:ThecopyrightprotectionmeasuresforfolkliteratureandartworksshallbeseparatelyformulatedbytheStateCouncil.Article7:ThecopyrightadministrativedepartmentoftheStateCouncilisresponsibleforthenationwidecopyrightmanagementwork;Thecopyrightadministrativedepartmentsofthepeople'sgovernmentsofeachprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentareresponsibleforthecopyrightmanagementworkintheirrespectiveadministrativeregions.Article8:Copyrightownersandrightsholdersrelatedtocopyrightmayauthorizecopyrightcollectivemanagementorganizationstoexercisecopyrightorrightsrelatedtocopyright.Afterbeingauthorized,thecollectivemanagementorganizationforcopyrightcanclaimrightsinitsownnameasthecopyrightownerandrelatedrightsholders,andcanactasapartytolitigationandarbitrationactivitiesinvolvingcopyrightorrelatedrights.Copyrightcollectivemanagementorganizationsarenon-profitorganizations,andtheirestablishmentmethods,rightsandobligations,collectionanddistributionofcopyrightlicensingfees,aswellassupervisionandmanagement,shallbeseparatelystipulatedbytheStateCouncil.Chapter2CopyrightSection1CopyrightOwnersandTheirRightsArticle9:Copyrightholdersinclude:(1)Author;(2)Othercitizens,legalpersonsorotherorganizationsthatenjoycopyrightinaccordancewiththisLaw.Article10:Copyrightincludesthefollowingpersonalandpropertyrights:(1)Therightofpublication,whichreferstotherighttodecidewhetheraworkshouldbemadepublicornot;(2)Therightofattribution,whichmeanstherighttoindicatetheauthor'sidentityandsigntheirnameonthework;(3)Therighttomodify,thatis,therighttomodifyorauthorizeotherstomodifyawork;(4)Therighttoprotecttheintegrityofawork,thatis,therighttoprotecttheworkfromdistortionortampering;(5)Therightofreproductionreferstotherighttoproduceoneormorecopiesofaworkthroughprinting,photocopying,rubbing,recording,videography,dubbing,orremaking;(6)Distributionrightreferstotherighttoprovidetheoriginalorcopiesofaworktothepublicthroughsaleorgift;(7)Rentalright,whichreferstotherighttotemporarilylicenseotherstousefilmworks,workscreatedbymethodssimilartofilmproduction,andcomputersoftwareforafee,exceptforcomputersoftwarethatisnotthemainsubjectofrental;(8)Exhibitionright,whichreferstotherighttopubliclydisplaytheoriginalorcopiesofartandphotographyworks;(9)Therighttoperform,whichreferstotherighttopubliclyperformworksandtopubliclybroadcasttheperformanceofworksthroughvariousmeans;(10)Projectionright,whichreferstotherighttopubliclyreproduceart,photography,films,andworkscreatedbymethodssimilartofilmproductionthroughtechnicalequipmentsuchasprojectorsandslideprojectors;(11)Broadcastingrightsrefertotherighttopubliclybroadcastordisseminateworksthroughwirelessmeans,todisseminatebroadcastworkstothepublicthroughwiredtransmissionorrebroadcasting,andtodisseminatebroadcastworkstothepublicthroughloudspeakersorothersimilartoolsthattransmitsymbols,sounds,andimages;(12)Therightofinformationnetworkdissemination,whichreferstotherighttoprovideworkstothepublicthroughwiredorwirelessmeans,sothatthepubliccanobtaintheworksattheirownchosentimeandplace;(13)Therighttofilm,whichreferstotherighttofixaworkonacarrierbyfilmingorusingamethodsimilartofilming;(14)Therightofadaptation,thatis,therighttochangeaworkandcreateanewworkwithoriginality;(15)Translationrightreferstotherighttotranslateaworkfromonelanguageintoanotherlanguage;(16)Assemblyrightreferstotherighttoselectorarrangeaworkorafragmentofaworktocompileitintoanewwork;(17)Otherrightsthatshouldbeenjoyedbythecopyrightowner.Thecopyrightownermaylicenseotherstoexercisetherightsspecifiedinitems(5)to(17)oftheprecedingparagraphandobtainremunerationinaccordancewiththeagreementorrelevantprovisionsofthisLaw.Thecopyrightownermaytransferallorpartoftherightsstipulatedinitems(5)to(17)ofthefirstparagraphofthisarticle,andreceiveremunerationinaccordancewiththeagreementorrelevantprovisionsofthislaw.Section2OwnershipofCopyrightArticle11:Copyrightbelongstotheauthor,exceptasotherwiseprovidedinthisLaw.Thecitizenwhocreatesaworkistheauthor.Workscreatedonbehalfofthewillofalegalpersonorotherorganizationunderthesupervisionofthelegalpersonorotherorganization,andforwhichthelegalpersonorotherorganizationisresponsible,shallbedeemedastheauthorbythelegalpersonorotherorganization.Ifthereisnoprooftothecontrary,thecitizen,legalpersonorotherorganizationwhosignstheworkshallbetheauthor.Article12:Thecopyrightofaworkproducedbyadapting,translating,annotating,ororganizinganexistingworkshallbeenjoyedbythepersonwhoadapted,translated,annotated,ororganizedit,buttheexerciseofcopyrightshallnotinfringeuponthecopyrightoftheoriginalwork.Article13:Forworkscocreatedbytwoormorepersons,thecopyrightshallbejointlyenjoyedbythecoauthors.Peoplewhodidnotparticipateinthecreationcannotbecomecoauthors.Ifacollaborativeworkcanbedividedandused,theauthorsmayseparatelyenjoythecopyrightoftheirrespectivecreatedparts,butexercisingthecopyrightshallnotinfringeontheoverallcopyrightofthecollaborativework.Article14:Aworkthatcompilesseveralworks,fragmentsofawork,ordataorothermaterialsthatdonotconstituteawork,andwhosecontentselectionorarrangementreflectsoriginality,isacompilationwork,anditscopyrightisenjoyedbythecompiler,buttheexerciseofcopyrightshallnotinfringeonthecopyrightoftheoriginalwork.Article15:Thecopyrightoffilmworksandworkscreatedbymethodssimilartofilmproductionshallbeenjoyedbytheproducer,butthescreenwriter,director,cinematographer,lyricist,composer,andotherauthorsshallhavetherightofattributionandtherighttoreceiveremunerationinaccordancewiththecontractsignedwiththeproducer.Theauthorsoffilmsandworkscreatedusingmethodssimilartofilmproduction,suchasscripts,music,etc.,thatcanbeusedseparately,havetherighttoexercisetheircopyrightindependently.Article16:Workscreatedbycitizenstocompletetheworktasksoflegalpersonsorotherorganizationsareworkscreatedinthecourseoftheirduties.Exceptasprovidedinthesecondparagraphofthisarticle,thecopyrightshallbeenjoyedbytheauthor,butlegalpersonsorotherorganizationshavetherighttousethemfirstwithintheirbusinessscope.Withintwoyearsofcompletionofthework,withouttheconsentoftheunit,theauthorshallnotallowathirdpartytousetheworkinthesamewayastheunit.Workscreatedinthecourseofofficialdutiesthatfallunderanyofthefollowingcircumstancesshallenjoytherightofattributionbytheauthor,whileothercopyrightrightsshallbeenjoyedbythelegalpersonorotherorganization,whichmayrewardtheauthor(1)Engineeringdesigndrawings,productdesigndrawings,maps,computersoftwareandotherjob-relatedworksthataremainlycreatedusingthematerialandtechnologicalconditionsoflegalpersonsorotherorganizationsandforwhichthelegalpersonsorotherorganizationsareresponsible;(2)Workscreatedinthecourseofofficialdutiesthataresubjecttocopyrightownershipbylegalpersonsorotherorganizationsasstipulatedbylaws,administrativeregulations,orcontractualagreements.Article17:Theownershipofcopyrightinworkscreatedundercommissionshallbeagreeduponbytheprincipalandthetrusteethroughacontract.Ifthereisnoclearagreementinthecontractornocontractisconcluded,thecopyrightbelongstothetrustee.Article18:Thetransferofownershipoforiginalworksofartandotherworksshallnotbedeemedasthetransferofcopyright,buttheexhibitionrightoftheoriginalworksofartshallbeenjoyedbytheowneroftheoriginal.Article19:Ifthecopyrightbelongstoacitizen,therightsstipulatedinArticle10,Paragraph1,Items(5)to(17)ofthisLawshallbetransferredinaccordancewiththeprovisionsoftheInheritanceLawduringtheprotectionperiodstipulatedinthisLawafterthecitizen'sdeath.Ifthecopyrightbelongstoalegalpersonorotherorganization,afterthechangeorterminationofthelegalpersonorotherorganization,therightsstipulatedinArticle10,Paragraph1,Items(5)to(17)ofthisLawshallbeenjoyedbythelegalpersonorotherorganizationthatassumesitsrightsandobligationsduringtheprotectionperiodstipulatedinthisLaw;Ifalegalpersonorotherorganizationdoesnotassumeitsrightsandobligations,itshallbeenjoyedbythestate.Section3ProtectionPeriodofRightsArticle20:Theprotectionperiodoftheauthor'srightofauthorship,rightofmodification,andrighttoprotecttheintegrityoftheworkshallnotbelimited.Article21:TheprotectionperiodoftherightofpublicationandtherightsprovidedforinArticle10,Paragraph1,Items(5)to(17)ofthisLawforworksofcitizensshallbethelifetimeoftheauthorandfiftyyearsafterhisdeath,endingonDecember31ofthefiftiethyearaftertheauthor'sdeath;Ifitisacollaborativework,itendsonDecember31stofthe50thyearafterthedeathofthelastdeceasedauthor.TheprotectionperiodofthepublicationrightandtherightsstipulatedinArticle10,Paragraph1,Items(5)to(17)ofthisLawforworksorcopyrights(excludingtherightofattribution)enjoyedbylegalpersonsorotherorganizationsinthecourseoftheirdutiesshallbefiftyyears,endingonDecember31ofthefiftiethyearafterthefirstpublicationofthework.However,iftheworkisnotpublishedwithinfiftyyearsafteritscreationiscompleted,thisLawshallnolongerprotectit.TheprotectionperiodoftherightofpublicationandtherightsstipulatedinArticle10,Paragraph1,Items(5)to(17)ofthisLawforfilmworks,workscreatedbymethodssimilartofilmproduction,andphotographicworksisfiftyyears,endingonDecember31ofthefiftiethyearafterthefirstpublicationofthework.However,iftheworkisnotpublishedwithinfiftyyearsafteritscreationiscompleted,thisLawwillnolongerprotectit.Section4LimitationsonRightsArticle22:Inthefollowingcircumstances,theuseofaworkmaybemadewithoutthepermissionofthecopyrightownerorpaymentofremuneration,buttheauthor'snameandthenameoftheworkshallbespecified,andotherrightsenjoyedbythecopyrightownerinaccordancewiththisLawshallnotbeinfringed:(1)Usingpublishedworksofothersforpersonallearning,research,orappreciation;(2)Tointroduceorcommentonacertainworkorexplainacertainissue,appropriatelyciteotherpeople'spublishedworksinthework;(3)Toreportcurrentaffairsnews,itisinevitabletoreproduceorquotepublishedworksinnewspapers,magazines,radiostations,televisionstationsandothermedia;(4)Newspapers,magazines,radiostations,televisionstationsandothermediapublishorbroadcastcurrentaffairsarticlesonpolitical,economic,religiousissuesthathavealreadybeenpublishedinothernewspapers,magazines,radiostations,televisionstationsandothermedia,exceptforthosewhoseauthorsdeclarethattheyarenotallowedtopublishorbroadcast;(5)Newspapers,magazines,radiostations,televisionstationsandothermediapublishorbroadcastspeechesdeliveredatpublicgatherings,exceptforthosewheretheauthordeclaresthattheyarenotallowedtobepublishedorbroadcast;(6)Translateorreproducepublishedworksinsmallquantitiesforclassroomteachingorscientificresearchinschools,forusebyteachingorresearchpersonnel,butnotforpublicationanddistribution;(7)Stateorgansusepublishedworkswithinareasonablescopetocarryouttheirofficialduties;(8)Forthepurposeofdisplayingorpreservingversions,libraries,archives,memorialhalls,museums,artgalleries,etc.mayreproduceworkscollectedintheirownlibraries;(9)Freeperformanceofpublishedworks,withoutchargingfeestothepublicorpayingremunerationtoperformers;(10)Copying,painting,photography,andvideorecordingofartworkssetupordisplayedinoutdoorpublicplaces;(11)TranslateworkscreatedinChineselanguagebyChinesecitizens,legalpersonsorotherorganizationsthathavealreadybeenpublishedintominoritylanguageworksforpublicationanddistributioninChina;(12)ConvertpublishedworksintoBrailleforpublication.Theprecedingprovisionsapplytorestrictionsontherightsofpublishers,performers,producersofaudioandvideorecordings,radiostations,andtelevisionstations.Article23:Textbookscompiledandpublishedfortheimplementationofthenine-yearcompulsoryeducationandnationaleducationplansmay,withoutthepermissionofthecopyrightowner,compilefragmentsofpublishedworks,shortwrittenworks,musicalworks,orindividualworksofartorphotographyinthetextbooks,unlesstheauthordeclaresinadvancethattheyarenotallowedtousethem.However,remunerationshallbepaidinaccordancewithregulations,theauthor'snameandthenameoftheworkshallbeindicated,andotherrightsenjoyedbythecopyrightownerinaccordancewiththisLawshallnotbeinfringed.Theprecedingprovisionsapplytorestrictionsontherightsofpublishers,performers,producersofaudioandvideorecordings,radiostations,andtelevisionstations.Chapter3CopyrightLicenseandTransferContractArticle24:Whenusingtheworksofothers,alicenseagreementshallbeconcludedwiththecopyrightowner,exceptforthosethatmaybeusedwithoutpermissionasstipulatedinthisLaw.Thelicenseagreementincludesthefollowingmaincontents:(1)Thetypesofrightslicensedforuse;(2)Therighttolicenseiseitherexclusiveornonexclusive;(3)Thegeographicalscopeandperiodofpermitteduse;(4)Paymentstandardsandmethods;(5)Liabilityforbreachofcontract;(6)Othercontentsthatbothpartiesconsidernecessarytobeagreedupon.Article25:WhentransferringtherightsstipulatedinArticle10,Paragraph1,Items(5)to(17)ofthisLaw,awrittencontractshallbeconcluded.Therightstransfercontractincludesthefollowingmaincontents:(1)Thenameofthework;(2)Thetypesandgeographicalscopeofthetransferredrights;(3)Transferprice;(4)Thedateandmethodofdeliveringthetransferprice;(5)Liabilityforbreachofcontract;(6)Othercontentsthatbothpartiesconsidernecessarytobeagreedupon.Article26:Ifcopyrightispledged,thepledgorandpledgeeshallregisterthepledgewiththecopyrightadministrativedepartmentoftheStateCouncil.Article27:Withouttheconsentofthecopyrightowner,theotherpartyshallnotexercisetherightsthatarenotexplicitlylicensedortransferredbythecopyrightownerinthelicenseandtransfercontract.Article28:Theremunerationstandardsfortheuseofaworkmaybeagreeduponbytheparties,ormaybepaidinaccordancewiththeremunerationstandardsformulatedbythecopyrightadministrativedepartmentoftheStateCouncilinconjunctionwithrelevantdepartments.Iftheparties'agreementisunclear,remunerationshallbepaidinaccordancewiththeremunerationstandardsformulatedbythecopyrightadministrativedepartmentoftheStateCouncilinconjunctionwithrelevantdepartments.Article29:Publishers,performers,producersofaudioandvideorecordings,radiostations,televisionstations,etc.whousetheworksofothersinaccordancewiththerelevantprovisionsofthisLawshallnotinfringeupontheauthor'srightsofattribution,modification,protectionoftheintegrityofthework,andtherighttoremuneration.Chapter4Publication,Performance,AudioandVideoRecording,andBroadcastingSection1PublicationofBooksandNewspapersArticle30:Bookpublisherswhopublishbooksshallenterintoapublishingcontractwiththecopyrightownerandpayremuneration.Article31:Theexclusivepublishingrightenjoyedbyabookpublisherinaccordancewiththecontractforaworkdeliveredforpublicationbythecopyrightownershallbeprotectedbylaw,andothersshallnotpublishthework.Article32:Thecopyrightownershalldelivertheworkwithinthetimelimitstipulatedinthecontract.Bookpublishersshallpublishbooksinaccordancewiththequalityanddeadlinestipulatedinthecontract.Ifabookpublisherfailstopublishwithintheagreedtimelimitinthecontract,theyshallbearcivilliabilityinaccordancewithArticle54ofthisLaw.Ifabookpublisherreprintsorrepublishesawork,theyshallnotifythecopyrightownerandpayremuneration.Ifthebookpublisherrefusestoreprintorrepublishthebookafteritisoutofstock,thecopyrightownerhastherighttoterminatethecontract.Article33:Ifacopyrightownersubmitsanarticletoanewspaperorjournalanddoesnotreceivenotificationfromthenewspaperorjournalwithin15daysfromthedateofpublication,orwithin30daysfromthedateofpublication,theymaysubmitthesameworktoanothernewspaperorjournal.Unlessotherwiseagreedbybothparties.Afterthepublicationofawork,exceptforthosedeclaredbythecopyrightownernottobereproducedorexcerpted,othernewspapersandmagazinesmayreproduceorpublishitasanabstractormaterial,butshallpayremunerationtothecopyrightownerinaccordancewithregulations.Article34:Bookpublishersmaymodifyordeleteworkswiththeauthor'spermission.Newspapersandmagazinescanmaketextualmodificationsanddeletionstoworks.Anymodificationstothecontentmustbeapprovedbytheauthor.Article35:Worksresultingfromtheadaptation,translation,annotation,organization,orcompilationofexistingworksshallobtainpermissionfromthecopyrightownersoftheadapted,translated,annotated,organized,orcompiledworksandtheoriginalworks,andpayremuneration.Article36:Publishershavetherighttolicenseorprohibitothersfromusingthelayoutdesignoftheirpublishedbooksorjournals.Theprotectionperiodoftherightsstipulatedintheprecedingparagraphistenyears,endingonDecember31ofthetenthyearafterthefirstpublicationofthebookorjournalusingthelayoutdesign.Section2PerformanceArticle37:Whenperformingusingworksofothers,performers(actors,performanceunits)shallobtainpermissionfromthecopyrightownerandpayremuneration.Theperformanceorganizerorganizestheperformance,obtainspermissionfromthecopyrightowner,andpaysremuneration.Theuseofadaptations,translations,annotations,andcompilationsofexistingworksforperformancesshallobtainpermissionfromthecopyrightownersoftheadaptations,translations,annotations,andcompilationsandtheoriginalworks,andpayremuneration.Article38:Performershavethefollowingrightstotheirperformances:(1)Identifytheperformer'sidentity;(2)Protecttheperformanceimagefromdistortion;(3)Authorizeotherstolivestreamandpubliclytransmittheirliveperformances,andreceiveremuneration;(4)Authorizeotherstorecordaudioandvideorecordingsandreceiveremuneration;(5)Authorizeotherstocopyanddistributeaudioandvideorecordingsoftheirperformances,andreceiveremuneration;(6)Authorizeotherstodisseminatetheirperformancestothepublicthroughinformationnetworksandreceivecompensation.Thelicenseeshallobtainpermissionfromthecopyrightownerandpayremunerationforusingtheworkinthemannerspecifiedinitems(3)to(6)oftheprecedingparagraph.Article39:TheprotectionperiodoftherightsprovidedforinArticle38,Paragraph1,Items(1)and(2)ofthisLawshallnotbelimited.TheprotectionperiodoftherightsstipulatedinArticle38,Paragraph1,Items(3)to(6)ofthisLawisfiftyyears,endingonDecember31ofthefiftiethyearaftertheperformance.Section3AudioandVideoRecordingArticle40:Producersofaudioandvideorecordingswhousetheworksofotherstoproduceaudioandvideorecordingsshallobtainpermissionfromthecopyrightownerandpayremuneration.Producersofaudioandvideorecordingswhouseadaptations,translations,annotations,orcompilationsofexistingworksshallobtainpermissionfromthecopyrightownersoftheadaptations,translations,annotations,orcompilationsandtheoriginalworks,andpayremuneration.Recordingproducerswhousemusicworksthathavebeenlegallyrecordedasrecordingproductsbyotherstoproducerecordingproductsmaynotobtainpermissionfromthecopyrightowner,butshallpayremunerationinaccordancewithregulations;Ifthecopyrightownerdeclaresthatitisnotallowedtobeused,itshallnotbeused.Article41:Whenproducingaudioandvideorecordings,theproducershallenterintoacontractwiththeperformerandpayremuneration.Article42:Producersofaudioandvideorecordingshavetherighttolicenseotherstoreproduce,distribute,rent,disseminatetothepublicthroughinformationnetworks,andreceiveremunerationfortheaudioandvideorecordingstheyproduce;Theprotectionperiodoftherightisfiftyyears,endingonDecember31stofthefiftiethyearafterthefirstproductionoftheproductiscompleted.Thelicenseeshallobtainpermissionfromthecopyrightownerandperformerandpayremunerationforcopying,distributing,anddisseminatingaudioandvideoproductstothepublicthroughinformationnetworks.Section4BroadcastingbyRadioandTelevisionStationsArticle43:Radioandtelevisionstationsbroadcastingunpublishedworksofothersshallobtainpermissionfromthecopyrightownerandpayremuneration.Radioandtelevisionstationsmaybroadcastworkspublishedbyotherswithoutthepermissionofthecopyrightowner,butshallpayremuneration.Article44:Radioandtelevisionstationsmaybroadcastpublishedaudiorecordingswithoutthepermissionofthecopyrightowner,butshallpayremuneration.Unlessotherwiseagreedbytheparties.ThespecificmeasuresshallbeformulatedbytheStateCouncil.Article45:Radioandtelevisionstationshavetherighttoprohibitthefollowingactswithouttheirpermission:(1)Broadcastandtelevisionrebroadcastit;(2)Recordthebroadcastandtelevisionitplaysonaudiovisualmediaandcopytheaudiovisualmedia.Theprotectionperiodoftherightsstipulatedintheprecedingparagraphisfiftyyears,endingonDecember31ofthefiftiethyearafterthefirstbroadcastoftheradioortelevision.Article46:Televisionstationsshallobtainpermissionfromtheproducerorvideoproducerandpayremunerationforbroadcastingotherpeople'sfilmworks,workscreatedbymethodssimilartofilmproduction,andvideorecordings;Toplayotherpeople'svideoproducts,permissionfromthecopyrightownershouldalsobeobtainedandremunerationshouldbepaid.Chapter5LegalResponsibilitiesandEnforcementMeasuresArticle47:Thosewhoengageinthefollowingactsofinfringementshallbearcivilliabilitiessuchascessationofinfringement,eliminationofimpact,apology,andcompensationforlosses,dependingonthecircumstances:(1)Publishingone'sworkwithoutthepermissionofthecopyrightowner;(2)Publishingaworkcreatedincollaborationwithothersasastandaloneworkwithoutthepermissionofthecollaboratingauthor;(3)Thosewhodidnotparticipateinthecreationandsignedothers'worksforpersonalfameandfortune;(4)Distortingoralteringtheworksofothers;(5)Plagiarizingsomeoneelse'swork;(6)Withoutthepermissionofthecopyrightowner,theuseofworksforexhibition,filmproduction,orsimilarfilmproductionmethods,ortheuseofworksthroughadaptation,translation,annotation,etc.,exceptasotherwiseprovidedinthisLaw;(7)Usingsomeoneelse'sworkforwhichremunerationshouldhavebeenpaidbuthasnotbeenpaid;(8)Rentingworksoraudioandvideorecordingswithoutthepermissionofthecopyrightownerorrightsholderrelatedtothecopyrightofthefilmworks,workscreatedbysimilarfilmingmethods,computersoftware,audioandvideorecordings,exceptasotherwiseprovidedinthisLaw;(9)Usingthelayoutdesignofbooksorjournalspublishedbythepublisherwithouttheirpermission;(10)Withouttheperformer'spermission,livestreamingorpubliclytransmittingtheirliveperformance,orrecordingtheirperformance;(11)Otheractsthatinfringeuponcopyrightandrelatedrightsandinterests.Article48:Thosewhoengageinthefollowingactsofinfringementshallbearcivilliabilitiessuchascessationofinfringement,eliminationofimpact,apology,andcompensationforlosses,dependingonthecircumstances;Ifitdamagesthepublicinterestatthesametime,thecopyrightadministrativedepartmentmayorderthecessationofinfringement,confiscateillegalgains,confiscateordestroyinfringingcopies,andmayimposefines;Inseriouscases,thecopyrightadministrativedepartmentmayalsoconfiscatematerials,tools,equipment,etc.mainlyusedformakinginfringingcopies;Ifacrimeiscommitted,criminalresponsibilityshallbepursuedinaccordancewiththelaw:(1)Copying,distributing,performing,screening,broadcasting,compiling,ordisseminatingworkstothepublicthroughinformationnetworkswithoutthepermissionofthecopyrightowner,exceptasotherwiseprovidedinthisLaw;(2)Publishingbooksthatothershaveexclusivepublishingrightsto;(3)Copyingordistributingaudioorvideorecordingsofaperformer'sperformancewithouttheirpermission,ordisseminatingtheirperformancetothepublicthroughinformationnetworks,exceptasotherwiseprovidedinthisLaw;(4)Reproduction,distribution,anddisseminationofaudioandvideorecordingstothepublicthroughinformationnetworkswithoutthepermissionoftheproducer,exceptasotherwiseprovidedinthisLaw;(5)Withoutpermission,broadcastingorcopyingradioortelevision,exceptasotherwiseprovidedinthisLaw;(6)Intentionallyavoidingordamagingthetechnicalmeasurestakenbytherightsholdertoprotectcopyrightorcopyrightrelatedrightsfortheirworks,audioandvideorecordings,etc.withoutthepermissionofthecopyrightownerorcopyrightrelatedrightsholder,exceptasotherwiseprovidedbylawsandadministrativeregulations;(7)Intentionallydeletingoralteringelectronicinformationrelatedtotherightsmanagementofworks,audioandvideorecordings,etc.withoutthepermissionofthecopyrightownerorrightsholdersrelatedtocopyright,exceptasotherwiseprovidedbylawsandadministrativeregulations;(8)Producingandsellingworkswithcounterfeitsignaturesofothers.Article49:Incaseofinfringementofcopyrightorrightsrelatedtocopyright,theinfringershallcompensatetherightholderfortheactuallossesincurred;Iftheactuallossesaredifficulttocalculate,compensationcanbegivenbasedontheinfringer'sillegalgains.Thecompensationamountshouldalsoincludethereasonableexpensespaidbytherightholdertostoptheinfringement.Iftheactuallossesoftherightsholderortheillegalgainsoftheinfringercannotbedetermined,thepeople'scourtshall,basedonthecircumstancesoftheinfringement,awardcompensationofupto500000yuan.Article50:Ifacopyrightownerorarightsholderrelatedtocopyrighthasevidencethatothersarecommittingorabouttocommitactsthatinfringeupontheirrights,andifnotstoppedinatimelymanner,itwillcauseirreparabledamagetotheirlegitimaterightsandinterests,theymayapplytothepeople'scourtformeasurestoorderthecessationoftherelevantactsandpropertypreservationbeforefilingalawsuit.Thepeople'scourtshallhandletheapplicationmentionedintheprecedingparagraphinaccordancewiththeprovisionsofArticles93to96and99oftheCivilProcedureLawofthePeople'sRepublicofChina.Article51:Inordertopreventinfringement,incaseswhereevidencemaybelostordifficulttoobtaininthefuture,copyrightownersorrightsholdersrelatedtocopyrightmayapplytothepeople'scourtforevidencepreservationbeforefilingalawsuit.Afteracceptingtheapplication,thepeople'scourtmustmakearulingwithin48hours;Ifpreservationmeasuresareordered,theyshallbeimmediatelyenforced.Thepeople'scourtmayordertheapplicanttoprovideguarantee.Iftheapplicantfailstoprovideguarantee,theapplicationshallberejected.Iftheapplicantdoesnotfilealawsuitwithinfifteendaysafterthepeople'scourttakespreservationmeasures,thepeople'scourtshallliftthepreservationmeasures.Article52:People'scourtsmayconfiscateillegalgains,infringingcopies,andpropertyusedforillegalactivitiesincasesinvolvinginfringementofcopyrightorrightsrelatedtocopyright.Article53:Ifthepublisherorproducerofacopycannotprovethattheirpublicationorproductionislegallyauthorized,orifthedistributorofacopyorthelessorofacopyofafilmworkoraworkcreatedbyamethodsimilartofilmproduction,computersoftware,oraudioorvideorecordingcannotprovethatthecopytheydistributeorrenthasalegalsource,theyshallbearlegalresponsibility.Article54:Ifapartyfailstoperformitscontractualobligationsorfailstoperformitscontractualobligationsinaccordancewiththeagreedconditions,itshallbearcivilliabilityinaccordancewithrelevantlawsandregulationssuchastheGeneralPrinciplesoftheCivilLawofthePeople'sRepublicofChinaandtheContractLawofthePeople'sRepublicofChina.Article55:Copyrightdisputesmaybemediated,orarbitrationmaybeappliedtoanarbitrationinstitutionbasedonawrittenarbitrationagreementreachedbythepartiesorthearbitrationclauseinthecopyrightcontract.Ifthepartiesdonothaveawrittenarbitrationagreementoranarbitrationclauseinthecopyrightcontract,theymaydirectlyfilealawsuitwiththepeople'scourt.Article56:Ifapartyisdissatisfiedwithanadministrativepenalty,theymayfilealawsuitwiththepeople'scourtwithinthreemonthsfromthedateofreceivingtheadministrativepenaltydecision.Iftheyfailtofilealawsuitorcomplywithinthetimelimit,thecopyrightadministrativedepartmentmayapplytothepeople'scourtforenforcement.Chapter6SupplementaryProvisionsArticle57:Theterm'copyright'referredtointhisLawmeanscopyright.Article58:ThepublicationreferredtoinArticle2ofthisLawreferstothereproductionanddistributionofworks.Article59:TheprotectionmeasuresfortherightofcomputersoftwareandinformationnetworkdisseminationshallbeseparatelyformulatedbytheStateCouncil.Article60:Therightsofcopyrightowners,publishers,performers,producersofaudioandvideorecordings,radiostations,andtelevisionstationsprovidedforinthisLawshallbeprotectedinaccordancewiththisLawiftheyhavenotexceededtheprotectionperiodprovidedforinthisLawonthedateofitsimplementation.Anyinfringementorbreachofcontractthatoccurredbeforetheimplementationofthislawshallbehandledinaccordancewiththerelevantregulationsandpoliciesatthetimeoftheinfringementorbreach.Article61:ThisLawshallcomeintoeffectonJune1,1991.

TheImplementationRegulationsoftheCopyrightLawofthePeople'sRepublicofChinaareherebypromulgated,whichshallcomeintoeffectonSeptember15,2002.PremierZhuRongjiAugust2nd,2002Article1:ThisregulationisformulatedinaccordancewiththeCopyrightLawofthePeople'sRepublicofChina(hereinafterreferredtoastheCopyrightLaw).Article2:WorksreferredtointheCopyrightLawrefertointellectualachievementsinthefieldsofliterature,art,andsciencethatareoriginalandcanbereplicatedinsometangibleform.Article3:CreationreferredtointheCopyrightLawreferstointellectualactivitiesthatdirectlyproduceliterary,artistic,andscientificworks.Organizingwork,providingconsultingopinions,materialconditions,orotherauxiliaryworkforothers'creationisnotconsideredascreation.Article4:ThemeaningsofthefollowingworksintheCopyrightLawandtheseRegulations:(1)Writtenworksrefertoworksexpressedinwrittenformsuchasnovels,poems,essays,andacademicpapers;(2)Oralworksrefertoworksexpressedintheformoforallanguage,suchasimpromptuspeeches,lectures,courtdebates,etc;(3)Musicworksrefertosongs,symphonies,andotherworksthatcanbesungorperformedwithorwithoutlyrics;(4)Dramaticworksrefertoworkssuchasplays,operas,andlocaloperasthatareperformedonstage;(5)Quyiworksrefertoworksperformedmainlyintheformofrap,suchascross-talk,faststorytelling,drumming,storytelling,etc;(6)Danceworksrefertoworksthatexpressthoughtsandemotionsthroughcontinuousmovements,postures,expressions,etc;(7)Acrobaticartworksrefertoworksofacrobatics,magic,circus,etc.thatareexpressedthroughphysicalmovementsandtechniques;(8)Artworksrefertotwo-dimensionalorthree-dimensionalaestheticworksofartcomposedoflines,colors,orotherformssuchaspainting,calligraphy,sculpture,etc;(9)Architecturalworksrefertoaestheticallysignificantworksexpressedintheformofbuildingsorstructures;(10)Photographicworksrefertoartisticworksthatrecordobjectiveobjectimagesonphotosensitivematerialsorothermediausinginstruments;(11)Filmworksandworkscreatedusingmethodssimilartofilmingrefertoworksthatarefilmedonacertainmedium,composedofaseriesofimageswithorwithoutaccompanyingsound,andareprojectedordisseminatedthroughappropriatedevices;(12)Graphicworksrefertoengineeringdesigndrawings,productdesigndrawings,aswellasmaps,diagrams,andotherworksthatreflectgeographicalphenomena,explaintheprinciplesorstructuresofthings,andaredrawnforconstructionandproductionpurposes;(13)Modelworksrefertothree-dimensionalworksmadeinacertainproportionaccordingtotheshapeandstructureofobjectsfordisplay,experiment,observationandotherpurposes.Article5:ThemeaningsofthefollowingtermsintheCopyrightLawandtheseRegulations:(1)Currentaffairsnewsreferstosimplefactualinformationreportedthroughmediasuchasnewspapers,magazines,radiostations,andtelevisionstations;(2)Audiorecordingsrefertoanyrecordingsofthesoundofaperformanceorothersounds;(3)Videorecordingsrefertoanycontinuousrelatedimagesorvisualrecordingswithorwithoutaccompanyingsound,otherthanfilmworksandworkscreatedbysimilarfilmingmethods;(4)Recordingproducerreferstothefirst-timeproducerofarecordedproduct;(5)Videoproducerreferstothefirst-timeproducerofavideoproduct;(6)Performersrefertoactors,performanceunits,orotherindividualswhoperformliteraryorartisticworks.Article6:Copyrightshallarisefromthedateofcompletionofthecreationofthework.Article7:ThecopyrightofworksbyforeignersorstatelesspersonsthatarefirstpublishedwithintheterritoryofChinaasstipulatedinArticle2,Paragraph3oftheCopyrightLawshallbeprotectedfromthedateoftheirfirstpublication.Article8:IfaworkofaforeignerorstatelesspersonisfirstpublishedoutsideofChinaandispublishedwithin30dayswithinChina,itshallbedeemedtohavebeenpublishedsimultaneouslywithinChina.Article9:Ifacollaborativeworkcannotbedividedforuse,itscopyrightshallbejointlyenjoyedbyallcollaboratingauthorsandexercisedthroughmutualagreement;Ifconsensuscannotbereachedthroughnegotiationandthereisnojustifiablereason,neitherpartyshallpreventtheotherpartyfromexercisinganyrightsotherthantransfer,buttheproceedsobtainedshallbereasonablydistributedtoallcoauthors.Article10:Ifthecopyrightownerpermitsotherstofilmtheirworksorcreateworksusingmethodssimilartofilmproduction,itshallbedeemedthattheyhaveagreedtomakenecessarymodificationstotheirworks,butsuchmodificationsshallnotdistortortamperwiththeoriginalworks.Article11:Theterm"worktask"inArticle16,Paragraph1oftheCopyrightLawregardingworkscreatedinthecourseofofficialdutiesreferstothedutiesthatcitizensshouldperforminthelegalpersonororganization.The"materialandtechnicalconditions"referredtoinArticle16,Paragraph2oftheCopyrightLawregardingworkscreatedinthecourseofofficialdutiesrefertothefunds,equipment,ormaterialsspeciallyprovidedbythelegalpersonororganizationforcitizenstocompletetheircreations.Article12:Withintwoyearsafterthecompletionofaworkinthecourseofone'sduties,withtheconsentoftheunit,theauthormayauthorizeathirdpartytousetheworkinthesamemannerastheunit,andtheremunerationobtainedshallbedistributedbetweentheauthorandtheunitinaccordancewiththeagreedproportion.Thetwo-yeardeadlineforcompletingtheworkshallbecalculatedfromthedatetheauthordeliverstheworktotheinstitution.Article13:Forworkswhoseauthor'sidentityisunknown,thecopyrightotherthantherightofattributionshallbeexercisedbytheowneroftheoriginalwork.Aftertheauthor'sidentityisdetermined,thecopyrightshallbeexercisedbytheauthorortheirsuccessor.Article14:Afterthedeathofoneofthecoauthors,ifnooneinheritsorbequeathstherightsprovidedforinArticle10,Paragraph1,Items(5)to(17)oftheCopyrightLaw,therightsenjoyedbythecoauthorsshallbeenjoyedbytheothercoauthors.Article15:Afterthedeathoftheauthor,therightsofattribution,modification,andprotectionoftheintegrityoftheworkintheauthor'scopyrightshallbeprotectedbytheauthor'sheirortestator.Ifnooneinheritsorbequeathsthecopyright,therighttoattribution,modification,andprotectionoftheintegrityoftheworkshallbeprotectedbythecopyrightadministrativedepartment.Article16:TheuseofworksforwhichthestateenjoyscopyrightshallbemanagedbythecopyrightadministrativedepartmentoftheStateCouncil.Article17:Forworksthathavenotbeenpublishedbytheauthorbeforetheirdeath,iftheauthordoesnotexplicitlystatethattheywillnotpublishthem,therighttopublishmaybeexercisedbytheheirortestatorwithin50yearsaftertheauthor'sdeath;Ifthereisnoheirandnoonehasbeenbequeathed,itshallbeexercisedbytheowneroftheoriginalwork.Article18:Forworkswhoseauthor'sidentityisunknown,theprotectionperiodoftherightsprovidedforinArticle10,Paragraph1,Items(5)to(17)oftheCopyrightLawshallendonDecember31ofthe50thyearafterthefirstpublicationofthework.Aftertheauthor'sidentityisdetermined,theprovisionsofArticle21oftheCopyrightLawshallapply.Article19:Whenusingtheworksofothers,theauthor'snameandthetitleoftheworkshallbespecified;However,unlessotherwiseagreedbythepartiesorcannotbespecifiedduetothenatureoftheuseofthework.Article20:Theterm"publishedworks"asusedintheCopyrightLawreferstoworksthatthecopyrightownerhasmadepublicorlicensedotherstomakepublic.Article21:AccordingtotherelevantprovisionsoftheCopyrightLaw,theuseofapublishedworkthatcanbeusedwithoutthepermissionofthecopyrightownershallnotaffectthenormaluseofthework,norshallitreasonablyharmthelegitimateinterestsofthecopyrightowner.Article22:TheremunerationstandardsfortheuseofworksinaccordancewiththeprovisionsofArticle23,Article32(2),andArticle39(3)oftheCopyrightLawshallbeformulatedandpublishedbythecopyrightadministrativedepartmentoftheStateCouncilinconjunctionwiththecompetentpricingdepartmentoftheStateCouncil.Article23:Whenusingtheworksofothers,alicenseagreementshallbeconcludedwiththecopyrightowner.Ifthelicensedrightisanexclusiveright,itshallbeinwriting,exceptforworkspublishedbynewspapersorperiodicals.Article24:ThecontentoftheexclusiverightofuseprovidedforinArticle24oftheCopyrightLawshallbestipulatedinacontract.Ifthereisnoagreementorunclearagreementinthecontract,itshallbedeemedthatthelicenseehastherighttoexcludeanyone,includingthecopyrightowner,fromusingtheworkinthesameway;Unlessotherwiseagreedinthecontract,thelicenseemustobtainpermissionfromthecopyrightownertoallowathirdpartytoexercisethesameright.Article25:Ifanexclusivelicenseortransfercontractisenteredintowiththecopyrightowner,itmaybefiledwiththecopyrightadministrativedepartmentforrecord.Article26:TherightsandinterestsrelatedtocopyrightreferredtointheCopyrightLawandtheseRegulationsrefertotherightsenjoyedbypublishersinthelayoutdesignoftheirpublishedbooksandjournals,performersintheirperformances,producersofaudioandvideorecordingsintheirproductions,andbroadcastingandtelevisionstationsintheirbroadcastsandtelevisionprograms.Article27:Publishers,performers,producersofaudioandvideorecordings,radiostations,andtelevisionstationsexercisingtheirrightsshallnotinfringeupontherightsofthecopyrightownersoftheworksbeingusedortheoriginalworks.Article28:Ifthebookpublishingcontractstipulatesthatthebookpublisherhasexclusivepublishingrightsbutdoesnotspecifytheirspecificcontent,itshallbedeemedthatthebookpublisherhastheexclusiverighttopublishtheoriginalorrevisedversionofthebookinthesamelanguageduringthevalidityperiodofthecontractandwithinthegeographicalscopespecifiedinthecontract.Article29:Ifthetwoorderssentbythecopyrightownertothebookpublisherarenotfulfilledwithin6months,itshallbedeemedthatthebookisoutofstockasreferredtoinArticle31oftheCopyrightLaw.Article30:IfthecopyrightownerdeclaresinaccordancewithArticle32(2)oftheCopyrightLawthattheirworkcannotbereproducedorexcerpted,theyshallattachadeclarationwhenpublishingtheworkinnewspapersormagazines.Article31:IfthecopyrightownerdeclaresinaccordancewithArticle39(3)oftheCopyrightLawthattheyshallnotmakeaudiorecordingsoftheirwork,theyshalldeclareitwhentheworkislegallyrecordedasanaudiorecording.Article32:InaccordancewiththeprovisionsofArticle23,Article32(2),andArticle39(3)oftheCopyrightLaw,ifsomeoneusesanotherperson'swork,theyshallpayremunerationtothecopyrightownerwithin2monthsfromthedateofuseofthework.Article33:PerformancesbyforeignersandstatelesspersonswithintheterritoryofChinaareprotectedbytheCopyrightLaw.Foreignersandstatelesspersons'rightstoperformunderinternationaltreatiestowhichChinaisapartyareprotectedbycopyrightlaw.Article34:AudiorecordingsproducedanddistributedbyforeignersandstatelesspersonswithintheterritoryofChinaareprotectedbytheCopyrightLaw.TherightsenjoyedbyforeignersandstatelesspersonsunderinternationaltreatiestowhichChinaisapartytotheproductionanddistributionofaudiorecordingsareprotectedbytheCopyrightLaw.Article35:TherightsenjoyedbyforeignradioandtelevisionstationsinbroadcastingandtelevisionprogramsinaccordancewithinternationaltreatiestowhichChinaisapartyareprotectedbytheCopyrightLaw.Article36:IfaninfringingactlistedinArticle47oftheCopyrightLawdamagesthepublicinterest,thecopyrightadministrativedepartmentmayimposeafineofnomorethanthreetimestheamountofillegalbusinessoperations;Forillegalbusinessoperationsthataredifficulttocalculate,afineofupto100000yuanmaybeimposed.Article37:IfthereareinfringingactslistedinArticle47oftheCopyrightLawthatalsoharmthepublicinterest,thecopyrightadministrativedepartmentofthelocalpeople'sgovernmentshallberesponsibleforinvestigatingandpunishingthem.ThecopyrightadministrativedepartmentoftheStateCouncilmayinvestigateanddealwithinfringementsthathaveasignificantimpactnationwide.Article38:ThisregulationshallcomeintoeffectonSeptember15,2002.TheImplementationRegulationsoftheCopyrightLawofthePeople'sRepublicofChina,approvedbytheStateCouncilonMay24,1991andissuedbytheNationalCopyrightAdministrationonMay30,1991,weresimultaneouslyabolished.

Implementing the provisions of international copyright treaties, on September 25, 1992, the State Council
Article1:Inordertoimplementinternationalcopyrighttreatiesandprotectthelegitimaterightsandinterestsofforeigncopyrightowners,theseregulationsareformulated.Article2:TheprotectionofforeignworksshallbegovernedbytheCopyrightLawofthePeople'sRepublicofChina(hereinafterreferredtoastheCopyrightLaw),theImplementationRegulationsoftheCopyrightLawofthePeople'sRepublicofChina,theRegulationsontheProtectionofComputerSoftware,andtheseRegulations.Article3:TheinternationalcopyrighttreatiesreferredtointheseregulationsrefertotheBernConventionfortheProtectionofLiteraryandArtisticWorks(hereinafterreferredtoastheBernConvention)towhichthePeople'sRepublicofChina(hereinafterreferredtoasChina)isaparty,aswellasbilateralagreementsoncopyrightsignedwithforeigncountries.Article4:Theforeignworksreferredtointheseregulationsinclude:(1)Worksinwhichtheauthororoneoftheauthors,othercopyrightholders,oroneofthecopyrightholdersisanationalofacountrythatisamemberofaninternationalcopyrighttreatyoraresidentwithahabitualresidenceinacountrythatisamemberofthetreaty;(2)Theauthorisnotanationalofamemberstateofaninternationalcopyrighttreatyorahabitualresidentofamemberstateofthetreaty,buttheworkwasfirstorsimultaneouslypublishedinamemberstateofthetreaty;(3)IfaSinoforeignjointventure,Sinoforeigncooperativeenterprise,orforeign-fundedenterpriseisthecopyrightowneroroneofthecopyrightownersasstipulatedinthecontract,andentrustsotherstocreatethework.Article5:TheprotectionperiodofunpublishedforeignworksshallbegovernedbytheprovisionsofArticles20and21oftheCopyrightLaw.Article6:Theprotectionperiodforforeignpracticalartworksshallbe25yearsfromthecompletionofthework.Artworks(includinganimatedimagedesign)usedforindustrialproductsarenotsubjecttotheprovisionsoftheprecedingparagraph.Article7:Foreigncomputerprogramsprotectedasliteraryworksmaynotrequireregistrationprocedures,andtheprotectionperiodshallbefiftyyearsfromtheendoftheyearwhentheprogramisfirstpublished.Article8:ForeignworksthatareeditedfromunprotectedmaterialsbuthaveoriginalityintheselectionorarrangementofmaterialsshallbeprotectedinaccordancewithArticle14oftheCopyrightLaw.Thisprotectiondoesnotexcludeothersfromusingthesamematerialsforediting.Article9:Foreignvideorecordingsthatconstitutefilmworksunderinternationalcopyrighttreatiesshallbeprotectedasfilmworks.Article10:WhentranslatingworkscreatedinHanChineselanguagethathavealreadybeenpublishedbyforeignersintominoritylanguagesforpublicationanddistribution,priorauthorizationfromthecopyrightownershallbeobtained.Article11:Foreigncopyrightownersmayauthorizeotherstopubliclyperformtheirworksorpubliclydisseminateperformancesoftheirworksinanywayorbyanymeans.Article12:Copyrightownersofforeignfilms,televisionandvideoworksmayauthorizeotherstopubliclyperformtheirworks.Article13:Whenreprintingforeignworksinnewspapersandmagazines,priorauthorizationfromthecopyrightownershallbeobtained;However,reprintingcurrentaffairsarticlesrelatedtopolitical,economic,andothersocialissuesisexcluded.Article14:Thecopyrightownerofaforeignworkmayauthorizeorprohibittherentalofcopiesoftheirworkafterauthorizingotherstodistributecopiesoftheirwork.Article15:Thecopyrightownerofaforeignworkhastherighttoprohibittheimportofthefollowingcopiesoftheirwork:(1)Infringingcopies;(2)Copiesfromcountriesthatdonotprotecttheirworks.Article16:Theperformance,recording,orbroadcastingofforeignworksshallbegovernedbytheprovisionsoftheBernConvention;Ifthereisacollectivemanagementorganization,authorizationfromtheorganizationshouldbeobtainedinadvance.Article17:ForeignworksthathavenotyetenteredthepublicdomaininthecountryoforiginonthedateofentryintoforceofinternationalcopyrighttreatiesinChinashallbeprotectedduringtheprotectionperiodstipulatedintheCopyrightLawandtheseRegulationsuntiltheirexpiration.TheprecedingparagraphdoesnotapplytotheuseofforeignworksthatoccurredbeforetheeffectivedateoftheinternationalcopyrighttreatyinChina.ChinesecitizensorlegalpersonswhopossessandusespecificcopiesofforeignworksforspecificpurposesbeforetheeffectivedateoftheinternationalcopyrighttreatyinChinamaycontinuetousethecopiesoftheworkwithoutassumingresponsibility;However,thiscopyshallnotbecopiedorusedinanywaythatunreasonablydamagesthelegitimaterightsandinterestsofthecopyrightownerofthework.ThefirstthreeprovisionsshallbeimplementedinaccordancewiththeprovisionsofthebilateralagreementsoncopyrightsignedbetweenChinaandrelevantcountries.Article18:Articles5,12,14,15,and17oftheseregulationsapplytoaudiorecordings.Article19:Iftherearedifferentprovisionsbetweenadministrativeregulationsoncopyrightandtheseregulationsbeforetheimplementationoftheseregulations,theseregulationsshallapply.Iftherearedifferentprovisionsbetweenthisregulationandinternationalcopyrighttreaties,theinternationalcopyrighttreatiesshallapply.Article20:TheNationalCopyrightAdministrationisresponsiblefortheimplementationofinternationalcopyrighttreatiesinChina.Article21:TheseregulationsshallbeinterpretedbytheNationalCopyrightAdministration.Article22:TheseregulationsshallcomeintoeffectonSeptember30,1992.

Regulations of the People's Republic of China on the Customs Protection of Intellectual Property Rights

Implementation Measures for Madrid International Trademark Registration, Order No. 7 of the State Administration for Industry and Commerce of the People's Republic of China
TheImplementationMeasuresfortheInternationalRegistrationofMadridTrademarkshavebeenreviewedandapprovedattheexecutivemeetingoftheStateAdministrationforIndustryandCommerceofthePeople'sRepublicofChina,andarenowpublished.TheywillcomeintoeffectonJune1,2003.DirectorWangZhongfuApril17th,2003Article1:InaccordancewithArticle12oftheImplementingRegulationsoftheTrademarkLawofthePeople'sRepublicofChina(hereinafterreferredtoastheImplementingRegulations),theseMeasuresareformulated.TheinternationalregistrationoftrademarksasstipulatedinArticle12oftheImplementationRegulationsreferstotheinternationalregistrationoftrademarksprocessedinaccordancewiththeMadridAgreementontheInternationalRegistrationofMarks(hereinafterreferredtoastheMadridAgreement),theProtocolrelatingtotheMadridAgreementontheInternationalRegistrationofMarks(hereinafterreferredtoastheMadridProtocol),andtheCommonImplementingRegulationsoftheMadridAgreementontheInternationalRegistrationofMarksandtheProtocolrelatingtotheMadridAgreementontheInternationalRegistrationofMarks(hereinafterreferredtoastheCommonImplementingRegulations).Article2:TheseMeasuresapplytointernationaltrademarkregistrationapplicationswithChinaasthecountryoforigin,applicationsforterritorialextensiondesignatingChina,andotherrelatedapplications.ThosewhohandletrademarkforeignregistrationthroughnonMadridsystemchannelsarenotwithinthescopeofadjustmentofthesemeasures.Theapplicantmayentrustatrademarkagencyorganization,orentrustaforeignrepresentativeorlawfirm,ortheiroverseasbranchtohandlethematterontheirbehalf.Article3:ForthosewhoapplyforinternationalregistrationofatrademarkwithChinaastheircountryoforigin,theyshallhaveagenuineandvalidplaceofbusinessinChina,orhaveadomicileinChina,orpossessChinesenationality.Article4:ThosewhohavethequalificationsforapplyingforinternationalregistrationoftrademarksasstipulatedinArticle3oftheseMeasuresandwhosetrademarkshavealreadybeenregisteredwiththeTrademarkOfficeoftheStateAdministrationforIndustryandCommerce(hereinafterreferredtoastheTrademarkOffice)mayapplyforinternationalregistrationofthetrademarkinaccordancewiththeMadridAgreement.ThosewhohavethequalificationsforapplyingforinternationalregistrationoftrademarksasstipulatedinArticle3oftheseMeasures,andwhosetrademarkshavealreadybeenregisteredintheTrademarkOfficeorhavesubmittedtrademarkregistrationapplicationstotheTrademarkOffice,mayapplyforinternationalregistrationofthetrademarkinaccordancewiththeMadridProtocol.Article5:ApplicationsforinternationalregistrationoftrademarksshallbeprocessedthroughtheTrademarkOffice.TheapplicantortheirauthorizedtrademarkagencycansubmittheapplicationdirectlytotheTrademarkOffice,orsendtheapplicationtotheTrademarkOffice.Article6:Mattersrelatedtothelaterdesignation,abandonment,cancellation,etc.ofinternationaltrademarkregistrationrelatedtotheMadridAgreementshallbehandledthroughtheTrademarkOffice.Thetransfer,deletion,changeofnameoraddressoftheregistrant,changeofnameoraddressoftheagent,renewalandothermattersrelatedtotheapplicationforinternationalregistrationoftrademarksrelatedtotheMadridAgreementcanbehandledthroughtheTrademarkOfficeordirectlytotheInternationalBureauoftheWorldIntellectualPropertyOrganization(hereinafterreferredtoastheInternationalBureau).Formattersrelatedtothelaterdesignation,transfer,deletion,abandonment,cancellation,changeofthenameoraddressoftheregistrant,changeofthenameoraddressoftheagent,renewal,etc.ofinternationaltrademarkregistrationrelatedtotheMadridProtocol,theycanbehandledthroughtheTrademarkOfficeordirectlythroughtheInternationalBureau.ForapplicationsprocessedthroughtheTrademarkOffice,theapplicantortheirauthorizedtrademarkagencycandirectlysubmittheapplicationtotheTrademarkOfficeorsendtheapplicationtotheTrademarkOffice.ForthosewhodirectlyapplytotheInternationalBureau,theapplicantortheirauthorizedtrademarkagencycansubmittheapplicationtotheInternationalBureauorsendtheapplicationtotheInternationalBureau.Article7:ThosewhoapplyforinternationalregistrationoftrademarksandhandleotherrelatedmattersthroughtheTrademarkOfficemayusetheEnglishorFrenchformsprovidedbytheInternationalBureau,orusetheChineseformsformulatedbytheTrademarkOffice,buttheyneedtopaytranslationfeestotheTrademarkOffice.Forthosewhoapplyforinternationaltrademarkregistrationandhandleotherrelatedmatters,inadditiontopayingtheprescribedfeesaccordingtotheJointImplementationRegulations,theyshouldalsopayahandlingfeetotheTrademarkOffice.Article8:Iftheapplicantforinternationaltrademarkregistrationisanaturalperson,theirChinesenameshallbespecified.Iftheapplicantisalegalpersonorotherorganization,theirfullChinesenameshouldbespecified.Ifnaturalpersons,legalpersonsorotherorganizationshavecorrespondingforeigntranslations,theymayindicatetheforeigntranslation.Ifthereisnoforeigntranslation,thecorrespondingChinesePinyinshouldbeindicated.Article9:Theapplicantshallindicatetheirdetailedaddress(includingmailingaddressandpostalcode),telephonenumber,faxnumber,etc.intheapplicationforinternationaltrademarkregistration.Article10:Anapplicationforinternationalregistrationofatrademarkmayspecifyonecategoryofgoodsorservices,ortwoormorecategoriesofgoodsorservices.Article11:Whenapplyingforinternationalregistrationofatrademark,theapplicantshallprovidethefollowingattachments:(1)Onecopyofthedomestictrademarkregistrationcertificate,oronecopyofthenoticeofacceptanceofthetrademarkregistrationapplicationissuedbytheTrademarkOffice;(2)Ifpriorityisrequested,oneproofofsuchpriorityshallbeprovided;(3)Onecopyoftheapplicant'squalificationcertificate,suchasacopyofthebusinesslicense,acopyoftheresidencecertificate,acopyoftheIDcard,etc;(4)Forthosewhoentrustanagent,onecopyoftheagent'spowerofattorney;(5)Twocopiesofthetrademarkdesign,withdimensionsnotexceeding80mmx80mmandnotlessthan20mmx20mm.Article12:ThedateonwhichtheTrademarkOfficereceivestheapplicationforinternationalregistrationofatrademarkshallbetheapplicationdate.Iftheinternationalregistrationapplicationforatrademarkisnotfilledoutinaccordancewiththeregulations,theTrademarkOfficeshallreturntheapplicationformandtheapplicationdateshallnotberetained.Theapplicationproceduresarebasicallycomplete,butifcorrectionsareneeded,theTrademarkOfficeshallnotifytheapplicantoritsagenttomakecorrectionswithin15daysfromthedateofreceiptofthenotification.ThedateonwhichtheTrademarkOfficedeliversthecorrectionnoticetothepartiesbymailshallbebasedonthepostmarkdateonwhichthepartiesreceivethecorrectionnotice.Ifthepostmarkdateisunclearorthereisnopostmark,orifithasnotbeenreturnedbythepostoffice,itshallbedeemedasdeliveredtothepartyconcernedafter15daysfromthedateofnotification.Ifnocorrectionismade,theapplicationshallbedeemedabandonedandtheTrademarkOfficeshallnotifytheapplicantinwriting.FortrademarkinternationalregistrationapplicationsorotherapplicationsprocessedthroughtheTrademarkOfficethatrequirepaymentaccordingtoregulations,relevantfeesshallbepaidtotheTrademarkOfficewithin15daysfromthedateofreceivingthepaymentnoticefromtheTrademarkOffice.ThedateonwhichtheTrademarkOfficedeliversthepaymentnoticetothepartiesbymailshallbebasedonthepostmarkdateonwhichthepartiesreceivethepaymentnotice.Ifthepostmarkdateisunclearorthereisnopostmark,orifithasnotbeenreturnedbythepostoffice,itshallbedeemedasdeliveredtothepartyconcernedafter15daysfromthedateofissuanceofthepaymentnotice.Ifthepaymentisnotmadeontime,theapplicationshallbedeemedabandonedandtheTrademarkOfficeshallnotifytheapplicantinwriting.Article13:IftheTrademarkOfficenotifiestheInternationalBureautorejectanapplicationforterritorialextensionofChinaonitsowninitiative,itshallnolongerconfirmtherejectionwiththeInternationalBureau.Article14:WithinthreemonthsfromthefirstdayofthemonthfollowingthepublicationoftheInternationalTrademarkAnnouncementbytheWorldIntellectualPropertyOrganization,anypersonmayraiseanobjectiontotheapplicationforterritorialextensionofdesignatedChinapublishedintheAnnouncementtotheTrademarkOffice.Anobjectionapplicationcaninvolveonecategoryofgoodsorservices,ortwoormorecategoriesofgoodsorservices.Iftheobjectorwithdrawstheobjectionapplication,theTrademarkOfficeshallterminatetheobjectionprocedureandnotifythepartiesinwriting.Article15:TheapplicantfortheterritorialextensionofadesignatedcollectivetrademarkorcertificationtrademarkinChinashall,withinthreemonthsfromthedateofregistrationofthetrademarkintheInternationalRegisteroftheInternationalBureauoftheWorldIntellectualPropertyOrganization,submittotheTrademarkOfficethroughthetrademarkagencyorganization,inaccordancewithrelevantregulations,theproofofsubjectqualification,trademarkusemanagementrules,andothersupportingdocuments.Ifthesubjectqualificationcertificate,trademarkusemanagementrules,andothersupportingdocumentsarenotsubmittedwithintheabove-mentioned3months,theTrademarkOfficewillrejecttheterritorialextensionapplicationofthecollectivetrademarkorcertificationtrademark.Article16:Ifthetransferorfailstoapplyforsimultaneoustransferinaccordancewiththelaw,theTrademarkOfficeshallnotifytheinternationaltrademarkregistranttomakecorrectionswithin30daysfromthedateofreceiptofthenotification;Ifthetransferisnotcorrecteduponexpiration,theTrademarkOfficeshalldecidethatthetransferisinvalidinChinaandmakeadeclarationtotheInternationalBureau.IfthepartyconcerneddisagreeswiththedeclarationoftheTrademarkOffice,theymayfilealawsuitwiththepeople'scourtwithin30daysfromthedateofreceivingthedeclarationfromtheTrademarkOffice.Ifnolawsuitisfileduponexpiration,theTrademarkOffice'sdecisionshalltakeeffect.TheeffectivedateisthedateonwhichtheTrademarkOfficemakesadecision.IfthedeletedcontentdoesnotmeettheclassificationrequirementsofgoodsorservicesinChina,theTrademarkOfficeshalldecidethatthedeletionisinvalidinChinaandmakeadeclarationtotheInternationalBureau.IfthepartyconcerneddisagreeswiththedeclarationoftheTrademarkOffice,theymayfilealawsuitwiththepeople'scourtwithin30daysfromthedateofreceivingthedeclarationfromtheTrademarkOffice.Ifnolawsuitisfileduponexpiration,theTrademarkOffice'sdecisionshalltakeeffect.TheeffectivedateisthedateonwhichtheTrademarkOfficemakesadecision.Article17:AnyonewhopermitsotherstousetheirinternationallyregisteredtrademarkwithintheterritoryofChinashallhandleitinaccordancewiththeTrademarkLawanditsimplementingregulations.Article18:IftheapplicantfortheextensionofChina'sterritoryisdesignatedtoreplacethetrademarkregistrationalreadyobtainedinChinawiththeinternationalregistrationoftheirtrademark,theinternationalregistrationshallnotaffecttherightsofthetrademarkregistrationalreadyobtainedinChina.IfinternationalregistrationisrequiredtoreplacepriornationalregistrationintheTrademarkOffice'strademarkregistrationbook,itshallbehandledthroughatrademarkagencyorganizationandfeesshallbepaidinaccordancewithregulations.Article19:IfaninternationallyregisteredtrademarkthathasalreadybeenprotectedinChinafallsunderthecircumstancesstipulatedinArticle41oftheTrademarkLaw,thetrademarkowner,interestedparty,orotherpersonmayapplytotheTrademarkReviewandAdjudicationBoardforadisputerulingorforarulingtorevokethetrademarkthathasbeenprotectedinChina,dependingonthecircumstances.TherulingapplicationshallbefiledaftertheexpirationoftherejectionperiodforthetrademarkinChina.Article20:ForthosewhodesignateChinatoprotectinternationallyregisteredtrademarks,theymayentrustatrademarkagencyorganizationtoapplytotheTrademarkOfficeforacertificateofprotectionoftheirtrademarkinChinafromthedateofexpirationoftherejectionperiodfortheirtrademark.Article21:TheseMeasuresshallcomeintoeffectonJune1,2003.TheImplementationMeasuresforMadridInternationalTrademarkRegistration,issuedbytheStateAdministrationforIndustryandCommerceonMay24,1996,weresimultaneouslyabolished.
