(PassedattheFourthMeetingoftheStandingCommitteeoftheSixthNationalPeople'sCongressonMarch12,1984,amendedforthefirsttimeaccordingtotheDecisiononAmendingthePatentLawofthePeople'sRepublicofChinaatthe27thMeetingoftheStandingCommitteeoftheSeventhNationalPeople'sCongressonSeptember4,1992,amendedforthesecondtimeaccordingtotheDecisiononAmendingthePatentLawofthePeople'sRepublicofChinaatthe17thMeetingoftheStandingCommitteeoftheNinthNationalPeople'sCongressonAugust25,2000,andamendedforthethirdtimeaccordingtotheDecisiononAmendingthePatentLawofthePeople'sRepublicofChinaattheSixthMeetingoftheStandingCommitteeoftheEleventhNationalPeople'sCongressonDecember27,2008.)catalogueChapter1GeneralProvisionsChapter2:ConditionsforGrantingPatentRightsChapter3PatentApplicationChapter4ExaminationandApprovalofPatentApplicationsChapter5:Term,Termination,andInvalidityofPatentRightsChapter6CompulsoryLicenseforPatentImplementationChapter7ProtectionofPatentRightsChapter8SupplementaryProvisionsChapter1GeneralProvisionsArticle1:Inordertoprotectthelegitimaterightsandinterestsofpatentholders,encourageinventionsandcreations,promotetheapplicationofinventionsandcreations,enhanceinnovationcapabilities,promotescientificandtechnologicalprogressandeconomicandsocialdevelopment,thisLawisformulated.Article2:TheinventionsandcreationsreferredtointhisLawrefertoinventions,utilitymodels,anddesigns.Inventionreferstoanewtechnicalsolutionproposedforaproduct,method,oritsimprovement.Utilitymodelreferstoanewtechnicalsolutionproposedfortheshape,structure,orcombinationofaproductthatissuitableforpracticaluse.Appearancedesignreferstoanewdesignthatisaestheticallypleasingandsuitableforindustrialapplications,whichcombinestheshape,pattern,ortheircombination,aswellasthecombinationofcolor,shape,andpatternofaproduct.Article3:ThepatentadministrationdepartmentoftheStateCouncilisresponsibleformanagingpatentworknationwide;Unifiedacceptanceandexaminationofpatentapplications,grantingpatentrightsinaccordancewiththelaw.Thedepartmentsresponsibleforpatentmanagementunderthepeople'sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentareresponsibleforpatentmanagementwithintheirrespectiveadministrativeregions.Article4:Iftheinventionorcreationforwhichapatentisappliedinvolvesnationalsecurityorsignificantintereststhatrequireconfidentiality,itshallbehandledinaccordancewithrelevantnationalregulations.Article5:Patentrightsshallnotbegrantedforinventionsorcreationsthatviolatelaws,socialethics,orharmpublicinterests.Patentrightsshallnotbegrantedforinventionsorcreationsthatviolatelawsandadministrativeregulationsbyobtainingorutilizinggeneticresourcesandrelyonsuchgeneticresources.Article6:Inventionsandcreationsmadeintheperformanceofthetasksoftheunitormainlyutilizingthematerialandtechnologicalconditionsoftheunitshallbedeemedasserviceinventionsandcreations.Therighttoapplyforpatentsforserviceinventionsandcreationsbelongstotheunit;Aftertheapplicationisapproved,theunitbecomesthepatentee.Therighttoapplyforapatentfornonserviceinventionsandcreationsbelongstotheinventorordesigner;Aftertheapplicationisapproved,theinventorordesignershallbethepatentee.Iftheunithasenteredintoacontractwiththeinventorordesignerregardingtherighttoapplyforapatentandtheownershipofthepatentrightforinventionsorcreationsmadeusingthematerialandtechnologicalconditionsoftheunit,suchagreementshallprevail.Article7:Nounitorindividualshallsuppressthenonserviceinventionorcreationpatentapplicationsofinventorsordesigners.Article8:Forinventionsorcreationsjointlycompletedbytwoormoreunitsorindividuals,orinventionsorcreationscompletedbyoneunitorindividualonbehalfofanotherunitorindividual,therighttoapplyforapatentbelongstotheunitorindividualthatcompletedorjointlycompletedthem,unlessotherwiseagreed;Aftertheapplicationisapproved,theapplyingunitorindividualbecomesthepatentee.Article9:Thesameinventionorcreationcanonlybegrantedonepatentright.However,ifthesameapplicantappliesforbothautilitymodelpatentandaninventionpatentforthesameinventionorcreationonthesameday,andtheutilitymodelpatentrightobtainedearlierhasnotbeenterminated,andtheapplicantdeclarestowaivetheutilitymodelpatentright,theinventionpatentrightmaybegranted.Iftwoormoreapplicantsapplyforpatentsforthesameinventionorcreation,thepatentrightshallbegrantedtothefirstapplicant.Article10:Therighttoapplyforapatentandthepatentrightmaybetransferred.Chineseunitsorindividualswhotransferpatentapplicationrightsorpatentrightstoforeigners,foreignenterprises,orotherforeignorganizationsshallhandletheproceduresinaccordancewithrelevantlawsandadministrativeregulations.Forthetransferofpatentapplicationrightsorpatentrights,thepartiesshallenterintoawrittencontractandregisteritwiththepatentadministrationdepartmentoftheStateCouncil,whichshallmakeanannouncement.Thetransferofpatentapplicationrightsorpatentrightsshalltakeeffectfromthedateofregistration.Article11:Afterthegrantofinventionandutilitymodelpatentrights,exceptasotherwiseprovidedinthisLaw,nounitorindividualshallexploitthepatentwithoutthepermissionofthepatentee,thatis,shallnotmanufacture,use,offerforsale,sellorimportthepatentedproductsforproductionandoperationpurposes,orusethepatentedmethodsoruse,offerforsale,sellorimportproductsdirectlyobtainedbythepatentedmethods.Afterthegrantofadesignpatent,nounitorindividualmayimplementthepatentwithoutthepermissionofthepatentee,thatis,maynotmanufacture,offerforsale,sell,orimportthedesignpatentproductforproductionandoperationpurposes.Article12:Anyunitorindividualwhoimplementsanotherperson'spatentshallenterintoalicenseagreementwiththepatenteeandpaythepatentusagefeetothepatentee.Thelicenseehasnorighttoallowanyentityorindividualoutsidethescopeofthecontracttoimplementthepatent.Article13:Afterthepublicationofaninventionpatentapplication,theapplicantmayrequesttheunitorindividualimplementingtheinventiontopayappropriatefees.Article14:Iftheinventionpatentsofstate-ownedenterprisesandinstitutionsareofgreatsignificancetothenationalorpublicinterests,therelevantcompetentdepartmentsoftheStateCouncilandthepeople'sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmay,uponapprovalbytheStateCouncil,decidetopromoteandapplythemwithintheapprovedscope,allowdesignatedunitstoimplementthem,andtheimplementingunitsshallpayroyaltiestothepatenteeinaccordancewithnationalregulations.Article15:Ifthecoownersofapatentapplicationrightorpatentrighthaveanagreementontheexerciseoftheirrights,suchagreementshallprevail.Ifthereisnoagreement,coownersmayindependentlyimplementorlicenseotherstoimplementthepatentthroughordinarylicensing;Ifothersarelicensedtoimplementthepatent,theroyaltiescollectedshallbedistributedamongthecoowners.Exceptasprovidedintheprecedingparagraph,theexerciseofthejointpatentapplicationrightorpatentrightshallrequiretheconsentofallcoowners.Article16:Unitsgrantedpatentrightsshallrewardinventorsordesignersofserviceinventionsorcreations;Aftertheimplementationofaninventionorcreationpatent,reasonableremunerationshallbegiventotheinventorordesignerbasedonthescopeofitspromotionandapplicationandtheeconomicbenefitsobtained.Article17:Inventorsordesignershavetherighttostateinpatentdocumentsthattheyareinventorsordesigners.Thepatenteehastherighttoindicatethepatentlogoontheirpatentedproductoritspackaging.Article18:Foreigners,foreignenterprises,orotherforeignorganizationswhodonothaveahabitualresidenceorplaceofbusinessinChinashallapplyforpatentsinChinainaccordancewiththeagreementssignedbetweentheirrespectivecountriesandChinaorinternationaltreatiesjointlyparticipatedin,orinaccordancewiththeprincipleofreciprocity,inaccordancewiththisLaw.Article19:Foreigners,foreignenterprises,orotherforeignorganizationswhodonothaveahabitualresidenceorplaceofbusinessinChinashallentrustalegallyestablishedpatentagencytohandlepatentapplicationsandotherpatentaffairsinChina.ChineseunitsorindividualswhoapplyforpatentsandhandleotherpatentaffairsinChinamayentrustlegallyestablishedpatentagenciestohandlethem.Patentagenciesshallcomplywithlawsandadministrativeregulations,andhandlepatentapplicationsorotherpatentaffairsasentrustedbytheprincipal;Exceptforpatentapplicationsthathavebeenpublishedorannounced,theprincipalshallberesponsibleforkeepingconfidentialthecontentofinventionsandcreationsmadebytheprincipal.ThespecificmanagementmeasuresforpatentagenciesshallbeformulatedbytheStateCouncil.Article20:AnyunitorindividualwhoappliesforapatentforaninventionorutilitymodelcompletedinChinatoaforeigncountryshallfirstreporttothepatentadministrationdepartmentoftheStateCouncilforconfidentialityexamination.TheproceduresanddeadlinesforconfidentialityreviewshallbeimplementedinaccordancewiththeregulationsoftheStateCouncil.ChineseunitsorindividualsmayfileinternationalpatentapplicationsinaccordancewithrelevantinternationaltreatiestowhichthePeople'sRepublicofChinaisaparty.Applicantswhofileinternationalpatentapplicationsshallcomplywiththeprovisionsoftheprecedingparagraph.ThepatentadministrativedepartmentoftheStateCouncilshallhandleinternationalpatentapplicationsinaccordancewithrelevantinternationaltreatiestowhichthePeople'sRepublicofChinaisaparty,thisLaw,andrelevantregulationsoftheStateCouncil.Forinventionsorutilitymodelsthatviolatetheprovisionsofthefirstparagraphofthisarticleandapplyforpatentsinforeigncountries,nopatentrightshallbegrantedifapatentisappliedforinChina.Article21:ThepatentadministrationdepartmentundertheStateCouncilanditsPatentReexaminationBoardshallhandlepatentapplicationsandrequestsinaccordancewithobjective,fair,accurate,andtimelyrequirementsinaccordancewiththelaw.ThepatentadministrativedepartmentoftheStateCouncilshallreleasepatentinformationinacomplete,accurate,andtimelymanner,andregularlypublishpatentbulletins.Beforethepublicationorannouncementofapatentapplication,thestaffandrelevantpersonneloftheStateCouncil'spatentadministrationdepartmentshallberesponsiblefortheconfidentialityofitscontent.Chapter2:ConditionsforGrantingPatentRightsArticle22:Inventionsandutilitymodelsgrantedpatentrightsshallpossessnovelty,creativity,andpracticality.Noveltyreferstotheinventionorutilitymodelnotbelongingtotheexistingtechnology;NounitorindividualhasfiledanapplicationforthesameinventionorutilitymodelwiththepatentadministrationdepartmentoftheStateCouncilbeforetheapplicationdate,anditisrecordedinthepatentapplicationdocumentsorpublishedpatentdocumentsaftertheapplicationdate.Creativityreferstotheoutstandingsubstantivefeaturesandsignificantprogressoftheinventioncomparedtoexistingtechnology,andtheutilitymodelhassubstantivefeaturesandprogress.Practicalityreferstotheabilityoftheinventionorutilitymodeltobemanufacturedorused,andtoproducepositiveeffects.Theexistingtechnologyreferredtointhislawreferstothetechnologythatisknowntothepublicbothdomesticallyandinternationallybeforetheapplicationdate.Article23:Thedesignforwhichapatentrightisgrantedshallnotbeanexistingdesign;NounitorindividualhasfiledanapplicationforthesamedesignwiththepatentadministrationdepartmentoftheStateCouncilbeforetheapplicationdateandrecordeditinthepatentdocumentspublishedaftertheapplicationdate.Thedesignforwhichapatentisgrantedshouldhaveacleardistinctioncomparedtoexistingdesignsorcombinationsofexistingdesignfeatures.Thedesigngrantedpatentrightsshallnotconflictwiththelegitimaterightsalreadyobtainedbyothersbeforetheapplicationdate.Theexistingdesignreferredtointhislawreferstoadesignthatisknowntothepublicbothdomesticallyandinternationallybeforetheapplicationdate.Article24:Ifaninventionorcreationforwhichapatentisappliedfallsunderanyofthefollowingcircumstanceswithinsixmonthsbeforetheapplicationdate,itshallnotloseitsnovelty:(1)FirstexhibitedataninternationalexhibitionsponsoredorrecognizedbytheChinesegovernment;(2)Firstpublishedatadesignatedacademicortechnicalconference;3)Othersdisclosetheircontentwithouttheapplicant'sconsent.Article25:Patentrightsshallnotbegrantedforthefollowingitems:(1)Scientificdiscoveries;(2)Therulesandmethodsofintellectualactivities;(3)Diagnosisandtreatmentmethodsfordiseases;(4)Animalandplantspecies;(5)Substancesobtainedbynucleartransformationmethod;(6)Thedesignthatprimarilyservesasanidentifierforthepattern,color,orcombinationofbothinprintedmaterials.Theproductionmethodsoftheproductslistedinitem(4)oftheprecedingparagraphmaybegrantedpatentrightsinaccordancewiththeprovisionsofthisLaw.Chapter3PatentApplicationArticle26:Applicantsforinventionorutilitymodelpatentsshallsubmitdocumentssuchasarequest,specification,abstract,andclaims.Therequestlettershallspecifythenameoftheinventionorutilitymodel,thenameoftheinventor,thenameoraddressoftheapplicant,andothermatters.Theinstructionmanualshouldprovideclearandcompleteexplanationsoftheinventionorutilitymodel,basedontheabilityoftechnicalpersonnelintherelevanttechnicalfieldtoimplementit;Whennecessary,thereshouldbeaccompanyingdrawings.Theabstractshouldbrieflyexplainthetechnicalpointsoftheinventionorutilitymodel.Theclaimsshallbebasedonthespecificationandclearlyandbrieflydefinethescopeofpatentprotectionrequested.Forinventionsandcreationsthatrelyongeneticresources,theapplicantshallspecifythedirectandoriginalsourcesofthegeneticresourcesinthepatentapplicationdocuments;Iftheapplicantisunabletoexplaintheoriginalsource,theyshallstatethereasons.Article27:Whenapplyingforadesignpatent,arequestletter,picturesorphotographsofthedesign,andabriefexplanationofthedesignshallbesubmitted.Therelevantpicturesorphotographssubmittedbytheapplicantshallclearlydisplaythedesignoftheproductforwhichpatentprotectionisrequested.Article28:ThedateonwhichthepatentadministrativedepartmentoftheStateCouncilreceivesthepatentapplicationdocumentsshallbetheapplicationdate.Iftheapplicationdocumentsaremailed,thedateofthepostmarksentshallbedeemedastheapplicationdate.Article29:IftheapplicantfilesapatentapplicationforthesamesubjectmatterinChinawithintwelvemonthsfromthedateofthefirstfilingofapatentapplicationforaninventionorutilitymodelinaforeigncountry,orwithinsixmonthsfromthedateofthefirstfilingofapatentapplicationforadesigninaforeigncountry,theapplicantmayenjoypriorityinaccordancewiththeagreementsignedbetweentheforeigncountryandChinaortheinternationaltreatyjointlyparticipatedin,orinaccordancewiththeprincipleofmutualrecognitionofpriority.IftheapplicantsubmitsapatentapplicationforthesamesubjectmattertothepatentadministrationdepartmentoftheStateCouncilwithintwelvemonthsfromthedateofthefirstpatentapplicationforinventionorutilitymodelinChina,theymayenjoypriority.Article30:Iftheapplicantrequestspriority,theyshallmakeawrittendeclarationatthetimeofapplicationandsubmitacopyofthefirstpatentapplicationdocumentwithinthreemonths;Ifnowrittendeclarationismadeoracopyofthepatentapplicationdocumentisnotsubmittedwithintheprescribedtime,itshallbedeemedthatnopriorityrighthasbeenclaimed.Article31:Aninventionorutilitymodelpatentapplicationshallbelimitedtooneinventionorutilitymodel.Twoormoreinventionsorutilitymodelsbelongingtoageneralinventiveconceptmaybefiledasoneapplication.Adesignpatentapplicationshouldbelimitedtoonedesign.Twoormoresimilarappearancedesignsofthesameproduct,ortwoormoreappearancedesignsofproductssoldorusedinsetsforthesamecategory,canbesubmittedasoneapplication.Article32:Theapplicantmaywithdrawtheirpatentapplicationatanytimebeforebeinggrantedthepatentright.Article33:Applicantsmaymodifytheirpatentapplicationdocuments,butmodificationstoinventionandutilitymodelpatentapplicationdocumentsshallnotexceedthescoperecordedintheoriginalspecificationandclaims,andmodificationstodesignpatentapplicationdocumentsshallnotexceedthescoperepresentedbytheoriginaldrawingsorphotographs.Chapter4ExaminationandApprovalofPatentApplicationsArticle34:Afterreceivinganinventionpatentapplication,thepatentadministrationdepartmentundertheStateCouncilshall,uponpreliminaryexaminationandfindingthatitmeetstherequirementsofthisLaw,publishitimmediatelyaftertheexpirationofeighteenmonthsfromthedateofapplication.ThepatentadministrativedepartmentoftheStateCouncilmay,upontherequestoftheapplicant,publishtheirapplicationassoonaspossible.Article35:Withinthreeyearsfromthedateoffilingforaninventionpatentapplication,thepatentadministrationdepartmentundertheStateCouncilmayconductsubstantiveexaminationoftheapplicationupontherequestoftheapplicantatanytime;Iftheapplicantfailstorequestsubstantiveexaminationwithintheprescribedtimewithoutjustifiablereasons,theapplicationshallbedeemedwithdrawn.Whendeemednecessary,thepatentadministrationdepartmentoftheStateCouncilmayconductsubstantiveexaminationofinventionpatentapplicationsonitsown.Article36:Whentheapplicantforaninventionpatentrequestssubstantiveexamination,theyshallsubmitreferencematerialsrelatedtotheirinventionpriortotheapplicationdate.Ifaninventionpatenthasalreadybeenappliedforinaforeigncountry,thepatentadministrationdepartmentoftheStateCouncilmayrequiretheapplicanttosubmit,withinaspecifiedperiodoftime,thematerialssearchedortheresultsoftheexaminationconductedinthatcountryforthepurposeofexaminingtheapplication;Iftheapplicationisnotsubmittedwithinthedeadlinewithoutjustifiablereasons,itshallbedeemedwithdrawn.Article37:IfthepatentadministrationdepartmentundertheStateCouncilfindsthataninventionpatentapplicationdoesnotcomplywiththeprovisionsofthisLawaftersubstantiveexamination,itshallnotifytheapplicantandrequirethemtostatetheiropinionswithinaspecifiedtimelimitormakeamendmentstotheirapplication;Ifthereisnojustifiablereasonfornotrespondingwithinthedeadline,theapplicationshallbedeemedwithdrawn.Article38:IftheStateCouncil'spatentadministrationdepartmentstillconsidersthataninventionpatentapplicationdoesnotcomplywiththeprovisionsofthisLawaftertheapplicanthasstatedtheiropinionsormademodifications,itshallberejected.Article39:Ifnogroundsforrejectionarefoundinthesubstantiveexaminationofaninventionpatentapplication,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontogranttheinventionpatentright,issueaninventionpatentcertificate,andregisterandannounceitatthesametime.Theinventionpatentrightshallcomeintoeffectfromthedateofannouncement.Article40:Ifnoreasonforrejectionisfoundinthepreliminaryexaminationofautilitymodelordesignpatentapplication,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontogranttheutilitymodelpatentrightorthedesignpatentright,issuethecorrespondingpatentcertificate,andregisterandannounceitatthesametime.Theutilitymodelpatentrightandthedesignpatentrightshallcomeintoeffectfromthedateofannouncement.Article41:ThepatentadministrationdepartmentundertheStateCouncilshallestablishaPatentReexaminationBoard.IfthepatentapplicantisdissatisfiedwiththedecisionoftheStateCouncil'spatentadministrativedepartmenttorejecttheapplication,theymayrequestareexaminationfromthePatentReexaminationBoardwithinthreemonthsfromthedateofreceivingthenotification.AfterthePatentReexaminationBoardconductsareview,itmakesadecisionandnotifiesthepatentapplicant.IfthepatentapplicantisdissatisfiedwiththereexaminationdecisionofthePatentReexaminationBoard,theymayfilealawsuitwiththepeople'scourtwithinthreemonthsfromthedateofreceivingthenotice.Chapter5:Term,Termination,andInvalidityofPatentRightsArticle42:Thetermofaninventionpatentrightistwentyyears,andthetermofautilitymodelpatentrightandadesignpatentrightistenyears,bothcalculatedfromthedateofapplication.Article43:Thepatenteeshallpayannualfeesstartingfromtheyearinwhichthepatentrightisgranted.Article44:Inanyofthefollowingcircumstances,thepatentrightshallterminatebeforetheexpirationoftheterm:(1)Notpayingtheannualfeeaccordingtoregulations;(2)Thepatenteewaivestheirpatentrightsinwriting.Ifthepatentrightterminatesbeforetheexpirationoftheterm,itshallberegisteredandannouncedbythepatentadministrationdepartmentoftheStateCouncil.Article45:FromthedatewhenthepatentadministrativedepartmentundertheStateCouncilannouncesthegrantofthepatentright,anyunitorindividualwhobelievesthatthegrantofthepatentrightdoesnotcomplywiththerelevantprovisionsofthisLawmayrequestthePatentReexaminationBoardtodeclarethepatentrightinvalid.Article46:ThePatentReexaminationBoardshallpromptlyexamineandmakeadecisiononarequestforinvalidationofapatentright,andnotifytherequesterandthepatentee.ThedecisiontodeclareapatentinvalidshallberegisteredandannouncedbythepatentadministrationdepartmentoftheStateCouncil.IfoneisdissatisfiedwiththedecisionofthePatentReexaminationBoardtodeclarethepatentrightinvalidormaintainthepatentright,theymayfilealawsuitwiththepeople'scourtwithinthreemonthsfromthedateofreceivingthenotice.Thepeople'scourtshallnotifytheopposingpartytotheinvalidationrequestproceduretoparticipateinthelitigationasathirdparty.Article47:Apatentrightdeclaredinvalidshallbedeemedtohaveceasedtoexistfromtheoutset.Thedecisiontodeclarethepatentrightinvalidshallnothaveretrospectiveeffectonthejudgmentsandmediationagreementsonpatentinfringementmadeandexecutedbythepeople'scourtbeforethedeclarationofthepatentrightinvalidity,thedecisionsonhandlingpatentinfringementdisputesthathavebeenfulfilledorenforced,aswellasthepatentimplementationlicensecontractsandpatentrighttransfercontractsthathavebeenfulfilled.However,compensationshouldbegivenforthelossescausedtoothersbythemaliciousactionsofthepatentee.Ifpatentinfringementcompensation,patentusagefees,orpatenttransferfeesarenotrefundedinaccordancewiththeprovisionsoftheprecedingparagraph,whichclearlyviolatestheprincipleoffairness,theyshallbefullyorpartiallyrefunded.Chapter6CompulsoryLicenseforPatentImplementationArticle48:Inanyofthefollowingcircumstances,thepatentadministrationdepartmentundertheStateCouncilmaygrantacompulsorylicensetoimplementaninventionpatentorutilitymodelpatentuponapplicationbyaunitorindividualthatmeetstheconditionsforimplementation:(1)Ifthepatenteefailstoimplementorfullyimplementtheirpatentwithoutjustifiablereasonsafterthreeyearsfromthedateofgrantofthepatentrightandfouryearsfromthedateoffilingthepatentapplication;(2)Theexerciseofpatentrightsbythepatenteeisrecognizedasmonopolisticbehaviorinaccordancewiththelaw,inordertoeliminateorreducetheadverseeffectsofsuchbehavioroncompetition.Article49:Intheeventofastateofemergencyorextraordinarycircumstancesinthecountry,orforthepurposeofpublicinterest,thepatentadministrationdepartmentundertheStateCouncilmaygrantacompulsorylicensetoimplementaninventionpatentorautilitymodelpatent.Article50:Forthepurposeofpublichealth,thepatentadministrationdepartmentundertheStateCouncilmaygrantacompulsorylicensetomanufactureandexportpatenteddrugstocountriesorregionsthatcomplywithrelevantinternationaltreatiestowhichthePeople'sRepublicofChinaisaparty.Article51:Ifaninventionorutilitymodelthathasobtainedapatenthassignificanttechnologicalprogresswithsignificanteconomicsignificancecomparedtoaninventionorutilitymodelthathasalreadyobtainedapatent,anditsimplementationreliesontheimplementationofthepreviousinventionorutilitymodel,thepatentadministrationdepartmentoftheStateCouncilmaygrantacompulsorylicensetoimplementthepreviousinventionorutilitymodelupontheapplicationofthelatterpatentee.Inthecaseofgrantingacompulsorylicenseforimplementationinaccordancewiththeprovisionsoftheprecedingparagraph,thepatentadministrationdepartmentundertheStateCouncilmayalsograntacompulsorylicensefortheimplementationofthesubsequentinventionorutilitymodelbasedontheapplicationofthepreviouspatentee.Article52:Iftheinventionorcreationinvolvedinacompulsorylicenseissemiconductortechnology,itsimplementationshallbelimitedtothepurposeofpublicinterestandthecircumstancesstipulatedinArticle48(2)ofthisLaw.Article53:ExceptforcompulsorylicensesgrantedinaccordancewithArticle48(2)andArticle50ofthisLaw,theimplementationofcompulsorylicensesshallmainlybeforthepurposeofsupplyingthedomesticmarket.Article54:UnitsorindividualsapplyingforcompulsorylicenseinaccordancewithArticle48(1)andArticle51ofthisLawshallprovideevidencetoprovethattheyhaverequestedthepatenteetograntpermissiontoimplementthepatentunderreasonableconditions,buthavenotbeengrantedpermissionwithinareasonabletime.Article55:ThedecisionmadebythepatentadministrationdepartmentoftheStateCounciltograntacompulsorylicenseforimplementationshallbepromptlynotifiedtothepatenteeandregisteredandannounced.Thedecisiontograntacompulsorylicenseshallspecifythescopeandtimeofimplementationbasedonthereasonsforthecompulsorylicense.Whenthereasonsforcompulsorylicenseareeliminatedandnolongeroccur,thepatentadministrativedepartmentundertheStateCouncilshall,upontherequestofthepatenteeandafterexamination,makeadecisiontoterminatetheimplementationofthecompulsorylicense.Article56:Unitsorindividualswhohaveobtainedacompulsorylicenseforimplementationdonotenjoyexclusiveimplementationrightsandhavenorighttoallowotherstoimplementthem.Article57:Unitsorindividualswhoobtaincompulsorylicensesforimplementationshallpayreasonableroyaltiestothepatentee,orhandletheissueofroyaltiesinaccordancewiththeprovisionsofrelevantinternationaltreatiestowhichthePeople'sRepublicofChinaisaparty.Forthepaymentofusagefees,theamountshallbenegotiatedbybothparties;Ifthetwopartiescannotreachanagreement,thepatentadministrativedepartmentoftheStateCouncilshallmakearuling.Article58:IfthepatenteeisdissatisfiedwiththedecisionoftheStateCouncil'spatentadministrationdepartmentontheimplementationofacompulsorylicense,orifthepatenteeandtheunitorindividualobtainingthecompulsorylicensearedissatisfiedwiththerulingoftheStateCouncil'spatentadministrationdepartmentontheusefeeofthecompulsorylicense,theymayfilealawsuitwiththepeople'scourtwithinthreemonthsfromthedateofreceivingthenotice.Chapter7ProtectionofPatentRightsArticle59:Thescopeofprotectionofaninventionorutilitymodelpatentrightshallbebasedonthecontentofitsclaims,andthespecificationanddrawingsmaybeusedtointerpretthecontentoftheclaims.Thescopeofprotectionofadesignpatentshallbebasedonthedesignoftheproductasshowninthepicturesorphotographs,andabriefdescriptionmaybeusedtoexplainthedesignoftheproductasshowninthepicturesorphotographs.Article60:Ifapatentisimplementedwithoutthepermissionofthepatentee,whichinfringesupontheirpatentrightsandcausesdisputes,thepartiesshallresolvethemthroughconsultation;Ifthepatenteeorinterestedpartyisunwillingtonegotiateorfailstoreachanagreement,theymayfilealawsuitwiththepeople'scourtorrequestthedepartmentinchargeofpatentworktohandleit.Whenthedepartmentresponsibleformanagingpatentworkdeterminesthattheinfringementisestablished,itmayordertheinfringertoimmediatelystoptheinfringement.Ifthepartyisdissatisfied,itmayfilealawsuitwiththepeople'scourtinaccordancewiththeAdministrativeLitigationLawofthePeople'sRepublicofChinawithin15daysfromthedateofreceivingthenoticeofhandling;Iftheinfringerfailstofilealawsuitorceasetheinfringingbehaviorwithintheprescribedperiod,thedepartmentinchargeofpatentmanagementmayapplytothepeople'scourtforcompulsoryenforcement.Thedepartmentresponsibleformanagingpatentworkmaymediatetheamountofcompensationforpatentinfringementupontherequestofthepartiesinvolved;Ifmediationfails,thepartiesmaybringalawsuittothepeople'scourtinaccordancewiththeCivilProcedureLawofthePeople'sRepublicofChina.Article61:Ifapatentinfringementdisputeinvolvesaninventionpatentforanewproductmanufacturingmethod,theunitorindividualmanufacturingthesameproductshallprovideproofthattheirproductmanufacturingmethodisdifferentfromthepatentedmethod.Ifapatentinfringementdisputeinvolvesautilitymodelpatentoradesignpatent,thepeople'scourtorthedepartmentinchargeofpatentworkmayrequirethepatenteeoraninterestedpartytoprovideapatentevaluationreportmadebythepatentadministrativedepartmentoftheStateCouncilaftersearching,analyzing,andevaluatingtherelevantutilitymodelordesign,asevidenceforthetrialandhandlingofpatentinfringementdisputes.Article62:Inapatentinfringementdispute,iftheaccusedinfringerhasevidencetoprovethatthetechnologyordesignimplementedbelongstoexistingtechnologyorexistingdesign,itdoesnotconstituteinfringementofthepatentright.Article63:Anyonewhocounterfeitsapatentshall,inadditiontobearingcivilliabilityinaccordancewiththelaw,beorderedbythedepartmentinchargeofpatentmanagementtorectifythesituationandmakeapublicannouncement.Theillegalgainsshallbeconfiscated,andafineofnomorethanfourtimestheillegalgainsmaybeimposed;Iftherearenoillegalgains,afineofupto200000yuanmaybeimposed;Thosewhocommitcrimesshallbeheldcriminallyresponsibleinaccordancewiththelaw.Article64:Whenthedepartmentinchargeofpatentmanagementinvestigatesanddealswithsuspectedactsofcounterfeitingpatentsbasedontheevidencealreadyobtained,itmayinquirewiththerelevantpartiesandinvestigatethesituationrelatedtothesuspectedillegalacts;Conducton-siteinspectionsofplaceswherethepartiesinvolvedaresuspectedofillegalactivities;Searchandcopycontracts,invoices,accountbooks,andotherrelevantmaterialsrelatedtosuspectedillegalactivities;Productsrelatedtosuspectedillegalactivitiescanbeinspected,andproductswithevidenceprovingthattheyarecounterfeitpatentscanbesealedorseized.Whenthedepartmentresponsibleformanagingpatentworkexercisesthepowersstipulatedintheprecedingparagraphinaccordancewiththelaw,thepartiesshallassistandcooperate,andshallnotrefuseorobstruct.Article65:Theamountofcompensationforpatentinfringementshallbedeterminedbasedontheactuallossessufferedbytherightholderasaresultoftheinfringement;Iftheactuallossisdifficulttodetermine,itcanbedeterminedbasedonthebenefitsobtainedbytheinfringerduetotheinfringement.Ifitisdifficulttodeterminethelossessufferedbytherightsholderorthebenefitsobtainedbytheinfringer,thereasonabledeterminationshallbebasedonthemultipleofthepatentlicensingfee.Thecompensationamountshouldalsoincludethereasonableexpensespaidbytherightholdertostoptheinfringement.Ifitisdifficulttodeterminethelossessufferedbytherightsholder,thebenefitsobtainedbytheinfringer,andthepatentlicensefee,thepeople'scourtmaydeterminecompensationrangingfrom10000yuanto1millionyuanbasedonfactorssuchasthetypeofpatentright,thenatureandcircumstancesoftheinfringement.Article66:Ifthepatenteeorinterestedpartyhasevidencetoprovethatanotherpersoniscommittingorabouttocommitaninfringementofthepatentright,andifitisnotstoppedinatimelymanner,itwillcauseirreparabledamagetotheirlegitimaterightsandinterests,theymayapplytothepeople'scourtformeasurestoorderthecessationoftherelevantactsbeforefilingalawsuit.Whentheapplicantsubmitsanapplication,theyshouldprovideaguarantee;Ifnoguaranteeisprovided,theapplicationwillberejected.Thepeople'scourtshallmakearulingwithin48hoursfromthetimeofacceptingtheapplication;Iftherearespecialcircumstancesthatrequireanextension,itcanbeextendedfor48hours.Iftherulingordersthecessationofrelevantbehavior,itshallbeimmediatelyexecuted.Ifthepartiesaredissatisfiedwiththeruling,theymayapplyforreconsiderationonce;Theexecutionoftherulingshallnotbesuspendedduringthereconsiderationperiod.Iftheapplicantdoesnotfilealawsuitwithin15daysfromthedatewhenthepeople'scourttakesmeasurestoorderthecessationoftherelevantbehavior,thepeople'scourtshallliftthemeasures.Ifthereisanerrorintheapplication,theapplicantshallcompensatetherespondentforthelossessufferedduetothecessationoftherelevantactions.Article67:Inordertopreventpatentinfringement,ifevidencemaybelostordifficulttoobtaininthefuture,thepatenteeorinterestedpartymayapplytothepeople'scourtforevidencepreservationbeforefilingalawsuit.Thepeople'scourtmaytakepreservationmeasuresandordertheapplicanttoprovideguarantees;Iftheapplicantdoesnotprovideguarantee,theapplicationwillberejected.Thepeople'scourtshallmakearulingwithin48hoursfromthetimeofacceptingtheapplication;Ifpreservationmeasuresareordered,theyshallbeexecutedimmediately.Iftheapplicantdoesnotfilealawsuitwithin15daysfromthedateofthepeople'scourttakingthepreservationmeasures,thepeople'scourtshallliftthemeasures.Article68:Thestatuteoflimitationsforfilingalawsuitforpatentinfringementistwoyears,calculatedfromthedateonwhichthepatenteeorinterestedpartybecomesawareorshouldhavebecomeawareoftheinfringement.Iftheinventionisusedwithoutpayingtheappropriateusagefeefromthepublicationoftheinventionpatentapplicationtothegrantofthepatentright,thestatuteoflimitationsforthepatenteetodemandpaymentoftheusagefeeistwoyears,calculatedfromthedatewhenthepatenteelearnedorshouldhaveknownthatsomeoneelsewasusingtheinvention.However,ifthepatenteekneworshouldhaveknownbeforethegrantofthepatentright,thestatuteoflimitationsshallbecalculatedfromthedateofthegrantofthepatentright.Article69:Anyofthefollowingcircumstancesshallnotbedeemedasinfringementofpatentrights:(1)Patentproductsorproductsdirectlyobtainedbypatentmethods,soldbythepatenteeorauthorizedunitsorindividuals,andthenused,promisedforsale,sold,orimportedtheproduct;(2)Thosewhohavealreadymanufacturedthesameproduct,usedthesamemethod,ormadenecessarypreparationsformanufacturingandusebeforethepatentapplicationdate,andcontinuetomanufactureanduseonlywithintheoriginalscope;(3)ForeigntransportvehiclestemporarilypassingthroughChina'sterritorialland,waters,andairspacemayuserelevantpatentsintheirdevicesandequipmentfortheirownneeds,inaccordancewithagreementssignedbetweentheirrespectivecountriesandChinaorinternationaltreatiesjointlyparticipatedin,orbasedontheprincipleofreciprocity;(4)Usingpatentsspecificallyforscientificresearchandexperimentation;(5)Manufacturing,using,orimportingpatenteddrugsormedicaldevicesforthepurposeofprovidinginformationrequiredforadministrativeapproval,aswellasmanufacturingorimportingpatenteddrugsormedicaldevicesspecificallyforthem.Article70:Ifapatentinfringingproductisused,promisedforsale,orsoldforthepurposeofproductionandoperationwithoutknowingthatitwasmanufacturedandsoldwithoutthepermissionofthepatentowner,anditcanbeproventhattheproductisoflegalorigin,noliabilityforcompensationshallbeborne.Article71:ThosewhoviolatetheprovisionsofArticle20ofthisLawbyapplyingforpatentsabroadanddisclosingstatesecretsshallbesubjecttoadministrativesanctionsbytheirrespectiveunitsorhigher-levelcompetentauthorities;Thosewhocommitcrimesshallbeheldcriminallyresponsibleinaccordancewiththelaw.Article72:AnyonewhoembezzlesthenonserviceinventionorcreationpatentapplicationrightandotherrightsandinterestsstipulatedinthisLawofaninventorordesignershallbesubjecttoadministrativesanctionsbytheiremployerorhigher-levelcompetentauthority.Article73:Thedepartmentresponsibleformanagingpatentworkshallnotparticipateinbusinessactivitiessuchasrecommendingpatentedproductstothesociety.Ifthedepartmentresponsibleformanagingpatentworkviolatestheprovisionsoftheprecedingparagraph,itssuperiorauthorityorsupervisoryauthorityshallorderittorectify,eliminatetheimpact,andconfiscateanyillegalincome;Ifthecircumstancesareserious,thedirectlyresponsiblesupervisorsandotherdirectlyresponsiblepersonnelshallbesubjecttoadministrativesanctionsinaccordancewiththelaw.Article74:Ifstatepersonnelengagedinpatentmanagementworkorotherrelevantstatepersonnelneglecttheirduties,abusetheirpower,engageinfavoritismandfraud,andcommitcrimes,theyshallbeheldcriminallyresponsibleinaccordancewiththelaw;Ifitdoesnotconstituteacrime,administrativesanctionsshallbeimposedinaccordancewiththelaw.Chapter8SupplementaryProvisionsArticle75:WhenapplyingforapatentandhandlingotherprocedureswiththepatentadministrationdepartmentoftheStateCouncil,feesshallbepaidinaccordancewithregulations.Article76:ThisLawshallcomeintoeffectonApril1,1985.

Detailed Rules for the Implementation of the Patent Law of the People

(AnnouncedbyOrderNo.306oftheStateCouncilofthePeople'sRepublicofChinaonJune15,2001,revisedforthefirsttimeaccordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChinaonDecember28,2002,andrevisedforthesecondtimeaccordingtotheDecisionoftheStateCouncilonAmendingtheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChinaonJanuary9,2010.)Chapter1GeneralProvisionsArticle1:ThesedetailedrulesareformulatedinaccordancewiththePatentLawofthePeople'sRepublicofChina(hereinafterreferredtoasthePatentLaw).Article2:AllproceduresstipulatedinthePatentLawandtheseImplementingRegulationsshallbehandledinwritingorinotherformsprescribedbythepatentadministrativedepartmentoftheStateCouncil.Article3:AlldocumentssubmittedinaccordancewiththePatentLawandtheseImplementingRegulationsshallbeinChinese;Ifthestatehasunifiedregulationsonscientificandtechnologicalterms,standardizedtermsshouldbeused;IfthereisnounifiedChinesetranslationforforeignnames,placenames,andtechnologicalterms,theoriginaltextshouldbeindicated.IfvariouscertificatesandsupportingdocumentssubmittedinaccordancewiththePatentLawandtheseImplementingRegulationsareinforeignlanguages,thepatentadministrationdepartmentundertheStateCouncilmay,whendeemednecessary,requirethepartiestoattachaChinesetranslationwithinaspecifiedperiodoftime;Ifthecertificateandsupportingdocumentsarenotattacheduponexpiration,itshallbedeemedthattheyhavenotbeensubmitted.Article4:AlldocumentsmailedtothepatentadministrationdepartmentundertheStateCouncilshallbesubmittedonthedateofthepostmarksent;Ifthepostmarkdateisunclear,unlessthepartiescanprovideproof,thesubmissiondateshallbethedateofreceiptbythepatentadministrationdepartmentundertheStateCouncil.VariousdocumentsissuedbythepatentadministrationdepartmentoftheStateCouncilmaybedeliveredtothepartiesconcernedbymail,directdelivery,orothermeans.Ifthepartiesentrustapatentagency,thedocumentsshallbesubmittedtothepatentagency;Forthosewhohavenotentrustedapatentagency,thecontactpersonspecifiedinthedocumentsubmissionrequestshallbeappointed.ThevariousdocumentsmailedbythepatentadministrationdepartmentoftheStateCouncilshallbepresumedtohavebeenreceivedbythepartiesconcernedafter15daysfromthedateofissuanceofthedocuments.AccordingtotheregulationsofthepatentadministrationdepartmentundertheStateCouncil,documentsthatshouldbedirectlysubmittedshallbedeemeddeliveredonthedateofdelivery.Ifthedeliveryaddressofthedocumentisunclearandcannotbemailed,itcanbedeliveredtothepartyconcernedthroughannouncement.Afteronemonthfromthedateofannouncement,thedocumentshallbedeemedtohavebeendelivered.Article5:ThefirstdayofvarioustimelimitsstipulatedinthePatentLawandtheseImplementingRegulationsshallnotbecountedtowardsthetimelimit.Ifthedeadlineiscalculatedinyearsormonths,thecorrespondingdayofthelastmonthshallbetheexpirationdateofthedeadline;Ifthereisnocorrespondingdayinthemonth,thedeadlineshallexpireonthelastdayofthemonth;Iftheexpirationdateisastatutoryholiday,thefirstworkingdayaftertheholidayshallbetheexpirationdate.Article6:IfapartydelaysthedeadlinestipulatedinthePatentLawortheseImplementingRegulationsorthedeadlinedesignatedbythepatentadministrationdepartmentundertheStateCouncilduetoforcemajeure,resultinginthelossofitsrights,itmayrequesttherestorationofitsrightsfromthepatentadministrationdepartmentundertheStateCouncilwithin2monthsfromthedateofeliminationoftheobstacle,andatthelatestwithin2yearsfromthedateofexpirationofthedeadline.Exceptforthecircumstancesspecifiedintheprecedingparagraph,ifapartydelaysthedeadlinestipulatedinthePatentLawortheseImplementingRegulationsorthedeadlinedesignatedbythepatentadministrationdepartmentundertheStateCouncilduetootherlegitimatereasons,resultinginthelossofitsrights,itmayrequesttherestorationofitsrightsfromthepatentadministrationdepartmentundertheStateCouncilwithin2monthsfromthedateofreceivingthenoticefromthepatentadministrationdepartmentundertheStateCouncil.Ifapartyrequeststherestorationoftheirrightsinaccordancewiththeprovisionsofthefirstorsecondparagraphofthisarticle,theyshallsubmitarequestforrestorationoftheirrights,explainthereasons,attachrelevantsupportingdocumentsifnecessary,andcompletethecorrespondingproceduresthatshouldbecompletedbeforethelossoftheirrights;Thosewhorequesttherestorationoftheirrightsinaccordancewiththeprovisionsofthesecondparagraphofthisarticleshallalsopayafeeforrequestingtherestorationoftheirrights.IfapartyrequestsanextensionofthetimelimitdesignatedbythepatentadministrationdepartmentoftheStateCouncil,theyshallexplainthereasonstothepatentadministrationdepartmentoftheStateCouncilandhandlerelevantproceduresbeforetheexpirationofthetimelimit.TheprovisionsofthefirstandsecondparagraphsofthisarticledonotapplytothetimelimitsstipulatedinArticles24,29,42,and68ofthePatentLaw.Article7:Ifapatentapplicationinvolvesnationaldefenseintereststhatrequireconfidentiality,itshallbeacceptedandexaminedbythenationaldefensepatentagency;IfthepatentapplicationacceptedbythepatentadministrationdepartmentoftheStateCouncilinvolvesnationaldefenseintereststhatneedtobekeptconfidential,itshallbepromptlytransferredtothenationaldefensepatentinstitutionforexamination.Ifnoreasonsforrejectionarefoundafterexaminationbythenationaldefensepatentinstitution,thepatentadministrativedepartmentoftheStateCouncilshallmakeadecisiontograntthenationaldefensepatentright.IfthepatentadministrationdepartmentoftheStateCouncilconsidersthattheinventionorutilitymodelpatentapplicationitacceptsinvolvesnationalsecurityormajorinterestsotherthannationaldefenseintereststhatneedtobekeptconfidential,itshallpromptlymakeadecisiontohandleitasaconfidentialpatentapplicationandnotifytheapplicant.Thespecialproceduresfortheexamination,reexamination,andinvalidationofconfidentialpatentapplicationsshallbeprescribedbythepatentadministrationdepartmentoftheStateCouncil.Article8:TheinventionorutilitymodelcompletedinChinareferredtoinArticle20ofthePatentLawmeansaninventionorutilitymodelinwhichthesubstantivecontentofthetechnicalsolutioniscompletedwithintheterritoryofChina.AnyunitorindividualwhoappliesforapatentforaninventionorutilitymodelcompletedinChinatoaforeigncountryshallrequestthepatentadministrationdepartmentoftheStateCounciltoconductaconfidentialityexaminationinoneofthefollowingways:(1)Forthosewhodirectlyapplyforpatentsabroadorsubmitinternationalpatentapplicationstorelevantforeigninstitutions,theyshallmakearequesttothepatentadministrativedepartmentoftheStateCouncilinadvanceandprovideadetailedexplanationoftheirtechnicalsolutions;(2)IfapersonintendstoapplyforapatentabroadorsubmitaninternationalpatentapplicationtoarelevantforeigninstitutionafterapplyingforapatentwiththepatentadministrationdepartmentoftheStateCouncil,theyshallmakearequesttothepatentadministrationdepartmentoftheStateCouncilbeforeapplyingforapatentabroadorsubmittinganinternationalpatentapplicationtoarelevantforeigninstitution.SubmittinganinternationalpatentapplicationtothepatentadministrationdepartmentoftheStateCouncilshallbedeemedassimultaneouslysubmittingarequestforconfidentialityexamination.Article9:IfthepatentadministrationdepartmentoftheStateCouncilreceivesarequestsubmittedinaccordancewithArticle8oftheseRulesand,afterexamination,considersthattheinventionorutilitymodelmayinvolvenationalsecurityorsignificantinterestsandneedstobekeptconfidential,itshallpromptlyissueanoticeofconfidentialityexaminationtotheapplicant;Iftheapplicanthasnotreceivedanoticeofconfidentialityexaminationwithin4monthsfromthedateofsubmissionoftheirrequest,theymayapplyforapatentfortheinventionorutilitymodelinaforeigncountryorsubmitaninternationalpatentapplicationtorelevantforeigninstitutions.IfthepatentadministrativedepartmentoftheStateCouncilnotifiestheconfidentialityexaminationinaccordancewiththeprovisionsoftheprecedingparagraph,itshallpromptlymakeadecisiononwhetherconfidentialityisrequiredandnotifytheapplicant.Iftheapplicantdoesnotreceiveadecisionrequiringconfidentialitywithin6monthsfromthedateofsubmissionoftheirrequest,theymayapplyforapatentfortheinventionorutilitymodelabroadorsubmitaninternationalpatentapplicationtorelevantforeigninstitutions.Article10:TheinventionorcreationthatviolatesthelawreferredtoinArticle5ofthePatentLawdoesnotincludeinventionsorcreationswhoseimplementationisprohibitedbylawalone.Article11:ExceptasprovidedinArticles28and42ofthePatentLaw,theapplicationdatereferredtointhePatentLaw,wherepriorityisclaimed,shallmeantheprioritydate.Theapplicationdatereferredtointheserules,unlessotherwisespecified,referstotheapplicationdatespecifiedinArticle28ofthePatentLaw.Article12:TheserviceinventionsandcreationscompletedintheexecutionofthetasksoftheunitreferredtoinArticle6ofthePatentLawreferto:(1)Inventionsandcreationsmadeinthecourseofone'sjob;(2)Inventionsandcreationsmadeoutsideofthedutiesassignedbytheunit;(3)Inventionsorcreationsmadewithinoneyearafterretirement,transferfromtheoriginalunit,orterminationoflabororpersonnelrelationsthatarerelatedtotheiroriginaljobresponsibilitiesortasksassignedbytheoriginalunit.Theterm'thisunit'referredtoinArticle6ofthePatentLawincludestemporaryemploymentunits;ThematerialandtechnologicalconditionsoftheunitreferredtoinArticle6ofthePatentLawrefertotheunit'sfunds,equipment,components,rawmaterials,ortechnicalinformationthatisnotpubliclydisclosed.Article13:TheinventorordesignerreferredtointhePatentLawmeansapersonwhohasmadecreativecontributionstothesubstantivefeaturesofaninventionorcreation.Intheprocessofcompletinganinventionorcreation,thosewhoareonlyresponsiblefororganizingwork,providingconveniencefortheutilizationofmaterialandtechnicalconditions,orengaginginotherauxiliaryworkarenotinventorsordesigners.Article14:ExceptforthetransferofpatentrightsinaccordancewithArticle10ofthePatentLaw,ifthepatentrightsaretransferredduetootherreasons,thepartiesshallhandlethepatentrighttransferprocedureswiththepatentadministrativedepartmentoftheStateCouncilbypresentingrelevantsupportingdocumentsorlegaldocuments.ThepatentimplementationlicensecontractconcludedbetweenthepatenteeandothersshallbefiledwiththepatentadministrativedepartmentoftheStateCouncilwithin3monthsfromtheeffectivedateofthecontract.Ifapatentrightispledged,thepledgorandthepledgeeshalljointlyregisterthepledgewiththepatentadministrationdepartmentoftheStateCouncil.Chapter2PatentApplicationArticle15:ThosewhoapplyforapatentinwritingshallsubmittwocopiesoftheapplicationdocumentstothepatentadministrationdepartmentundertheStateCouncil.ApplicationsforpatentsinotherformsprescribedbythepatentadministrationdepartmentoftheStateCouncilshallcomplywiththeprescribedrequirements.IftheapplicantentrustsapatentagencytoapplyforapatentandhandleotherpatentaffairswiththepatentadministrativedepartmentoftheStateCouncil,apowerofattorneyshallbesubmittedatthesametime,specifyingthescopeofthepowerofattorney.Iftherearetwoormoreapplicantsandnopatentagencyhasbeenappointed,unlessotherwisestatedintherequest,thefirstapplicantspecifiedintherequestshallbetherepresentative.Article16:Therequestforaninvention,utilitymodel,ordesignpatentapplicationshallspecifythefollowingmatters:(1)Thenameoftheinvention,utilitymodelordesign;(2)IftheapplicantisaChineseunitorindividual,theirname,address,postalcode,organizationcode,orresidentidentitycardnumber;Iftheapplicantisaforeigner,foreignenterpriseorotherforeignorganization,theirname,nationalityorregisteredcountryorregion;(3)Thenameoftheinventorordesigner;(4)Iftheapplicantentrustsapatentagency,thenameandagencycodeoftheentrustedagency,aswellasthename,practicelicensenumber,andcontactphonenumberofthedesignatedpatentagentoftheagency;(5)Forthosewhorequestpriority,thedateofthefirstpatentapplicationfiledbytheapplicant(hereinafterreferredtoasthepriorapplication),theapplicationnumber,andthenameoftheoriginalacceptinginstitution;(6)Signatureorsealoftheapplicantorpatentagency;(7)Listofapplicationdocuments;(8)Listofadditionaldocuments;(9)Otherrelevantmattersthatneedtobespecified.Article17:Thespecificationofaninventionorutilitymodelpatentapplicationshallspecifythenameoftheinventionorutilitymodel,whichshallbeconsistentwiththenameintherequest.Theinstructionmanualshouldincludethefollowingcontents:(1)Technicalfield:specifythetechnicalfieldtowhichtherequestedprotectedtechnicalsolutionbelongs;(2)Backgroundtechnology:Provideusefulbackgroundtechnologyforunderstanding,searching,andexamininginventionsorutilitymodels;Possibleandcitedocumentsreflectingthesebackgroundtechnologies;(3)Inventioncontent:statethetechnicalproblemtobesolvedbytheinventionorutilitymodelandthetechnicalsolutionadoptedtosolveit,andcomparethebeneficialeffectsoftheinventionorutilitymodelwiththeexistingtechnology;(4)Explanationofaccompanyingdrawings:Ifthereareaccompanyingdrawingsintheinstructionmanual,abriefexplanationofeachdrawingshouldbeprovided;(5)Specificimplementationmethod:Specifyindetailthepreferredmethodthattheapplicantbelievestoimplementtheinventionorutilitymodel;Ifnecessary,giveexamplestoillustrate;Forthosewithaccompanyingdrawings,pleaserefertotheattacheddrawings.Theapplicantforaninventionorutilitymodelpatentshallwritethespecificationinthemannerandorderspecifiedintheprecedingparagraph,andindicatethetitlebeforeeachpartofthespecification,unlessthenatureoftheinventionorutilitymodelcanbesavedbywritingitinanotherwayorordertoenableotherstoaccuratelyunderstandtheinventionorutilitymodel.Thedescriptionofaninventionorutilitymodelshallusestandardizedvocabularyandclearlanguage,andshallnotusequotationssuchas"asclaimedintheclaims...",norshallitusecommercialpromotionallanguage.Ifaninventionpatentapplicationcontainsoneormorenucleotideoraminoacidsequences,thespecificationshallincludeasequencelistthatcomplieswiththeregulationsofthepatentadministrationdepartmentundertheStateCouncil.Theapplicantshallsubmitthesequencelistasaseparatepartofthespecificationandprovideacomputer-readablecopyofthesequencelistinaccordancewiththeregulationsofthepatentadministrationdepartmentundertheStateCouncil.Thespecificationofautilitymodelpatentapplicationshallincludedrawingsindicatingtheshape,structure,orcombinationthereofoftheproductforwhichprotectionissought.Article18:Severaldrawingsofaninventionorutilitymodelshallbenumberedandarrangedintheorderof"Figure1,Figure2,...".Thereferencenumbersnotmentionedinthetextoftheinventionorutilitymodelspecificationshallnotappearinthedrawings,andthereferencenumbersnotappearinginthedrawingsshallnotbementionedinthetextofthespecification.Thereferencenumbersindicatingthesamecomponentintheapplicationdocumentsshouldbeconsistent.Exceptfornecessarywords,thereshouldbenootherannotationsintheattacheddrawings.Article19:Theclaimsshallrecordthetechnicalfeaturesoftheinventionorutilitymodel.Ifthereareseveralclaimsintheclaims,theyshouldbenumberedinArabicnumeralorder.Thetechnicaltermsusedintheclaimsshallbeconsistentwiththoseusedinthespecification,andmayhavechemicalormathematicalformulas,butshallnothaveillustrations.Unlessabsolutelynecessary,theuseofphrasessuchas"asdescribedintheinstructionmanual"or"asshowninthefigure"isnotallowed.Thetechnicalfeaturesintheclaimsmayrefertothecorrespondingmarkingsintheaccompanyingdrawingsofthespecification,whichshouldbeplacedafterthecorrespondingtechnicalfeaturesandenclosedinparenthesestofacilitateunderstandingoftheclaims.Theaccompanyingsymbolsshallnotbeinterpretedaslimitingtheclaims.Article20:Theclaimsshallhaveindependentclaimsandmayalsohavedependentclaims.Independentclaimsshouldreflectthetechnicalsolutionoftheinventionorutilitymodelasawhole,andrecordthenecessarytechnicalfeaturestosolvethetechnicalproblem.Dependentclaimsshouldfurtherlimitthecitedclaimswithadditionaltechnicalfeatures.Article21:Theindependentclaimsofaninventionorutilitymodelshallincludeapreambleandafeaturepart,andshallbewritteninaccordancewiththefollowingprovisions:(1)Preface:Clearlystatethetitleoftheclaimedinventionorutilitymodeltechnicalsolutionandthenecessarytechnicalfeaturesthattheinventionorutilitymodelsubjectshareswiththeclosestexistingtechnology;(2)Characteristicsection:Use"itscharacteristicis..."orsimilarlanguagetoindicatethetechnicalfeaturesthatdistinguishtheinventionorutilitymodelfromtheclosestexistingtechnology.Thesefeatures,togetherwiththefeaturesstatedinthepreamble,definethescopeofprotectionrequiredfortheinventionorutilitymodel.Ifthenatureoftheinventionorutilitymodelisnotsuitableforexpressionintheprecedingparagraph,theindependentclaimsmaybewritteninotherways.Aninventionorutilitymodelshallhaveonlyoneindependentclaim,whichshallbewrittenbeforethedependentclaimsofthesameinventionorutilitymodel.Article22:Thedependentclaimsofaninventionorutilitymodelshallincludeareferencepartandalimitationpart,andshallbewritteninaccordancewiththefollowingprovisions:(1)Referencesection:specifythenumberandsubjectmatternameofthecitedclaims;(2)Restrictedsection:Specifytheadditionaltechnicalfeaturesoftheinventionorutilitymodel.Dependentclaimscanonlyrefertotheprecedingclaims.Multipledependentclaimsthatcitetwoormoreclaimscanonlycitetheprecedingclaiminaselectivemannerandcannotserveasthebasisforanothermultipledependentclaim.Article23:Theabstractofthespecificationshallstateasummaryofthedisclosedcontentoftheinventionorutilitymodelpatentapplication,thatis,thenameoftheinventionorutilitymodelandthetechnicalfieldtowhichitbelongs,andclearlyreflectthetechnicalproblemtobesolved,thekeypointsofthetechnicalsolutiontosolvetheproblem,andthemainpurpose.Theabstractoftheinstructionmanualmayincludethechemicalformulathatbestillustratestheinvention;Apatentapplicationwithaccompanyingdrawingsshallalsoprovideadrawingthatbestillustratesthetechnicalfeaturesoftheinventionorutilitymodel.Thesizeandclarityoftheattachedimageshouldensurethatwhentheimageisreducedto4cmx6cm,alldetailsintheimagecanstillbeclearlydistinguished.Theabstracttextshouldnotexceed300words.Commercialpromotionallanguageshallnotbeusedintheabstract.Article24:Iftheinventionforwhichapatentisappliedinvolvesanewbiologicalmaterialthatisnotavailabletothepublicandthedescriptionofthebiologicalmaterialisinsufficientfortechnicalpersonnelintherelevantfieldtoimplementtheinvention,inadditiontocomplyingwiththerelevantprovisionsofthePatentLawandtheseImplementingRegulations,theapplicantshallalsohandlethefollowingprocedures:(1)SubmitthesampleofthebiologicalmaterialtoapreservationinstitutionrecognizedbytheStateCouncil'spatentadministrationdepartmentforpreservationbeforeoratthelatestontheapplicationdate(ifpriorityisclaimed,theprioritydate),andsubmitthepreservationcertificateandsurvivalcertificateissuedbythepreservationinstitutionatthetimeofapplicationoratthelatestwithin4monthsfromtheapplicationdate;Ifthecertificateisnotsubmitteduponexpiration,thesampleshallbedeemednottohavebeensubmittedforpreservation;(2)Provideinformationonthecharacteristicsofthebiologicalmaterialintheapplicationdocuments;(3)Patentapplicationsinvolvingthepreservationofbiologicalmaterialsamplesshallspecifyintherequestandspecificationtheclassificationandnamingofthebiologicalmaterial(withaLatinname),thenameandaddressoftheunitthatpreservesthebiologicalmaterialsample,thedateofpreservation,andthepreservationnumber;Ifitisnotspecifiedatthetimeofapplication,itshallbesupplementedwithin4monthsfromthedateofapplication;Ifnocorrectionismadeuponexpiration,itshallbedeemedthatthedeposithasnotbeensubmitted.Article25:IfanapplicantforaninventionpatentdepositsasampleofbiologicalmaterialinaccordancewiththeprovisionsofArticle24oftheseImplementingRegulations,andafterthepublicationoftheinventionpatentapplication,anyunitorindividualneedstousethebiologicalmaterialinvolvedinthepatentapplicationforexperimentalpurposes,theyshallmakearequesttothepatentadministrationdepartmentoftheStateCouncilandspecifythefollowingmatters:(1)Thenameoraddressoftherequester;(2)Noguaranteetoprovidethebiologicalmaterialtoanyoneelse;(3)Theguaranteethatitwillonlybeusedforexperimentalpurposesbeforegrantingpatentrights.Article26:GeneticresourcesreferredtointhePatentLawrefertomaterialsderivedfromhuman,animal,plant,ormicrobialsourcesthatcontaingeneticfunctionalunitsandhaveactualorpotentialvalue;TheinventionorcreationrelyingongeneticresourcesreferredtointhePatentLawreferstotheinventionorcreationcompletedbyutilizingthegeneticfunctionsofgeneticresources.Ifan ingcircumstances,itshallnotbeusedasabasisforclaimingdomesticpriority:(1)Hasrequestedforeignpriorityordomesticpriority;(2)Thosewhohavealreadybeengrantedpatentrights;(3)Belongingtothedivisionalapplicationsubmittedinaccordancewithregulations.Iftheapplicantclaimsdomesticpriority,theearlierapplicationshallbedeemedwithdrawnfromthedateoffilingofthelaterapplication.Article33:IfanapplicantwhodoesnothaveahabitualresidenceorplaceofbusinessinChinaappliesforapatentorclaimsforeignpriority,thepatentadministrationdepartmentundertheStateCouncilmay,whendeemednecessary,requirethemtoprovidethefollowingdocuments:(1)Iftheapplicantisanindividual,theirnationalitycertificate;(2)Proofdocumentsfromthecountryorregionwheretheapplicantisregistered,iftheapplicantisanenterpriseorotherorganization;(3)Theapplicant'scountryrecognizesthatChineseunitsandindividualscanenjoypatentrights,priorityrights,andotherpatentrelatedrightsunderthesameconditionsasnationalsofthatcountry.Article34:AccordingtoArticle31(1)ofthePatentLaw,twoormoreinventionsorutilitymodelsbelongingtoageneralinventiveconceptthatcanbefiledasapatentapplicationshallbetechnicallyinterrelatedandcontainoneormoreidenticalorcorrespondingspecifictechnicalfeatures.Specifictechnicalfeaturesrefertothetechnicalfeaturesthateachinventionorutilitymodelcontributestotheexistingtechnologyasawhole.Article35:AccordingtoArticle31(2)ofthePatentLaw,ifmultiplesimilardesignsofthesameproductarefiledasoneapplication,theotherdesignsoftheproductshallbesimilartothebasicdesignspecifiedinthebriefdescription.Thenumberofsimilardesignsinadesignpatentapplicationshallnotexceed10.Theterm"twoormoredesignsofproductsofthesamecategoryandsoldorusedinsets"referredtoinArticle31(2)ofthePatentLawmeansthateachproductbelongstothesamemajorcategoryintheclassificationtable,ishabituallysoldorusedsimultaneously,andthedesignsofeachproducthavethesamedesignconcept.Iftwoormoreappearancedesignsaresubmittedasoneapplication,thesequentialnumbersofeachappearancedesignshouldbemarkedbeforethenamesofeachimageorphotographofeachappearancedesignproduct.Article36:Ifanapplicantwithdrawsapatentapplication,theyshallmakeadeclarationtothepatentadministrationdepartmentundertheStateCouncil,specifyingthenameoftheinventionorcreation,theapplicationnumber,andtheapplicationdate.IfthestatementtowithdrawthepatentapplicationismadeaftertheStateCouncil'spatentadministrationdepartmenthasmadepreparationsfortheprintingofthepatentapplicationdocuments,theapplicationdocumentsshallstillbepublished;However,thedeclarationofwithdrawalofthepatentapplicationshallbeannouncedinthepatentgazettepublishedinthefuture.Chapter3ExaminationandApprovalofPatentApplicationsArticle37:Inthepreliminaryexamination,substantiveexamination,reexamination,andinvalidationprocedures,ifthepersonnelconductingtheexaminationandtrialhaveanyofthefollowingcircumstances,theyshallrecusethemselves,andthepartiesorotherinterestedpartiesmayrequesttheirrecusal:(1)Ifitisacloserelativeofthepartyortheiragent;(2)Havinganinterestinpatentapplicationsorpatentrights;(3)Havingotherrelationshipswiththepartiesortheiragentsthatmayaffectfairexaminationandtrial;(4)MembersofthePatentReexaminationBoardhaveparticipatedintheexaminationoftheoriginalapplication.Article38:Afterreceivingarequest,specification(includingdrawings),andclaimsforaninventionorutilitymodelpatentapplication,orarequest,drawingsorphotographsofadesignpatentapplication,andabriefexplanation,thepatentadministrationdepartmentundertheStateCouncilshallspecifytheapplicationdate,giveanapplicationnumber,andnotifytheapplicant.Article39:Ifapatentapplicationdocumentfallsunderanyofthefollowingcircumstances,thepatentadministrativedepartmentundertheStateCouncilshallnotacceptitandnotifytheapplicant:(1)Ifaninventionorutilitymodelpatentapplicationlacksarequest,specification(withoutaccompanyingdrawings),orclaims,orifadesignpatentapplicationlacksarequest,drawingsorphotographs,orabriefexplanation;(2)NotusingChinese;(3)NotincompliancewiththeprovisionsofArticle121,Paragraph1ofthesedetailedrules;(4)Therequestletterlackstheapplicant'snameoraddress;(5)ClearlynotincompliancewiththeprovisionsofArticle18orArticle19(1)ofthePatentLaw;(6)Thecategoryofpatentapplication(invention,utilitymodelordesign)isunclearordifficulttodetermine.Article40:Ifthespecificationincludesanexplanationoftheaccompanyingdrawingsbutlacksanyorpartofthem,theapplicantshallsubmitthesupplementarydrawingsordeclarethecancellationoftheexplanationofthedrawingswithinthetimelimitdesignatedbythepatentadministrationdepartmentundertheStateCouncil.Iftheapplicantsubmitsadditionaldrawings,thedateofsubmissionormailingofthedrawingstothepatentadministrationdepartmentundertheStateCouncilshallbedeemedastheapplicationdate;Iftheexplanationoftheattacheddrawingsiscancelled,theoriginalapplicationdateshallberetained.Article41:Iftwoormoreapplicantsapplyforpatentsforthesameinventionorcreationonthesameday(referringtotheapplicationdate;ifpriorityisclaimed,referringtotheprioritydate),theyshall,afterreceivingnotificationfromthepatentadministrationdepartmentundertheStateCouncil,independentlynegotiatetodeterminetheapplicant.Ifthesameapplicantappliesforbothautilitymodelpatentandaninventionpatentforthesameinventionorcreationonthesameday(referringtotheapplicationdate),theyshallseparatelystateatthetimeofapplicationthatanotherpatenthasbeenappliedforthesameinventionorcreation;Forthosenotspecified,theyshallbehandledinaccordancewithArticle9(1)ofthePatentLaw,whichstipulatesthatonlyonepatentrightcanbegrantedforthesameinventionorcreation.WhenthepatentadministrationdepartmentoftheStateCouncilannouncesthegrantofutilitymodelpatentrights,itshallannouncetheexplanationthattheapplicanthassimultaneouslyappliedforaninventionpatentinaccordancewiththeprovisionsofparagraph2ofthisarticle.Ifnoreasonforrejectionisfoundintheexaminationofaninventionpatentapplication,thepatentadministrationdepartmentundertheStateCouncilshallnotifytheapplicanttodeclarethewaiveroftheutilitymodelpatentrightwithintheprescribedtimelimit.Iftheapplicantdeclaresabandonment,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontogranttheinventionpatentrightandannouncetheapplicant'sdeclarationofabandonmentoftheutilitymodelpatentrighttogetherwiththeannouncementofthegrantoftheinventionpatentright.Iftheapplicantdoesnotagreetogiveup,thepatentadministrativedepartmentoftheStateCouncilshallrejecttheinventionpatentapplication;Iftheapplicantfailstorespondwithinthetimelimit,itshallbedeemedthattheinventionpatentapplicationhasbeenwithdrawn.Theutilitymodelpatentrightshallterminatefromthedateofannouncementofthegrantoftheinventionpatentright.Article42:Ifapatentapplicationincludestwoormoreinventions,utilitymodels,ordesigns,theapplicantmaysubmitadivisionalapplicationtothepatentadministrationdepartmentundertheStateCouncilbeforetheexpirationofthetimelimitspecifiedinArticle54,paragraph1oftheseImplementingRegulations;However,ifthepatentapplicationhasbeenrejected,withdrawn,ordeemedwithdrawn,adivisionalapplicationcannotbefiled.IfthepatentadministrativedepartmentoftheStateCouncilconsidersthatapatentapplicationdoesnotcomplywiththeprovisionsofArticle31ofthePatentLawandArticles34or35oftheseImplementingRegulations,itshallnotifytheapplicanttomodifytheapplicationwithinaspecifiedperiodoftime;Iftheapplicantfailstorespondwithinthetimelimit,theapplicationshallbedeemedwithdrawn.Theapplicationfordivisionshallnotchangethecategoryoftheoriginalapplication.Article43:AdivisionalapplicationfiledinaccordancewithArticle42oftheseRulesmayretaintheoriginalfilingdate.Ifpriorityisenjoyed,theprioritydatemayberetained,butitshallnotexceedthescoperecordedintheoriginalapplication.ThedivisionalapplicationshallgothroughrelevantproceduresinaccordancewiththeprovisionsofthePatentLawandtheseImplementingRegulations.Therequestfordivisionalapplicationshallspecifytheapplicationnumberandapplicationdateoftheoriginalapplication.Whensubmittingadivisionalapplication,theapplicantshallprovideacopyoftheoriginalapplicationdocuments;Iftheoriginalapplicationenjoyspriority,acopyoftheprioritydocumentoftheoriginalapplicationshallbesubmitted.Article44:ThepreliminaryexaminationreferredtoinArticles34and40ofthePatentLawreferstotheexaminationofwhetherapatentapplicationcontainsthedocumentsandothernecessarydocumentsspecifiedinArticles26or27ofthePatentLaw,whetherthesedocumentscomplywiththeprescribedformat,andtheexaminationofthefollowingitems:(1)WhethertheinventionpatentapplicationclearlyfallsunderthecircumstancesstipulatedinArticle5andArticle25ofthePatentLaw,whetheritdoesnotcomplywiththeprovisionsofArticle18,Article19(1),Article20(1)ofthePatentLaworArticle16andArticle26(2)oftheseRules,whetheritclearlydoesnotcomplywiththeprovisionsofArticle2(2),Article26(5),Article31(1),Article33ofthePatentLaworArticles17to21oftheseRules;(2)WhethertheutilitymodelpatentapplicationclearlyfallsunderthecircumstancesstipulatedinArticle5andArticle25ofthePatentLaw,whetheritdoesnotcomplywiththeprovisionsofArticle18,Article19(1),Article20(1)ofthePatentLaw,orArticles16to19and21to23oftheseRules,whetheritclearlydoesnotcomplywiththeprovisionsofArticle2(3),Article22(2),(4),Article26(3),(4),Article31(1),Article33oftheseRules,orwhetheritcannotobtainapatentrightinaccordancewithArticle9ofthePatentLaw;(3)WhetherthedesignpatentapplicationclearlyfallsunderthecircumstancesstipulatedinArticle5,Article25(1)(6)ofthePatentLaw,whetheritdoesnotcomplywiththeprovisionsofArticle18,Article19(1)ofthePatentLaworArticles16,27,and28oftheseImplementingRegulations,whetheritclearlydoesnotcomplywiththeprovisionsofArticle2(4),Article23(1),Article27(2),Article31(2),Article33,orArticle43(1)oftheseImplementingRegulations,andwhetheritcannotobtainapatentrightinaccordancewithArticle9ofthePatentLaw;(4)DoestheapplicationdocumentcomplywiththeprovisionsofArticle2andArticle3,Paragraph1ofthesedetailedrules.ThepatentadministrativedepartmentoftheStateCouncilshallnotifytheapplicantoftheexaminationopinionandrequirethemtostatetheiropinionsormakecorrectionswithinaspecifiedperiodoftime;Iftheapplicantfailstorespondwithinthetimelimit,theirapplicationshallbedeemedwithdrawn.IfthepatentadministrativedepartmentundertheStateCouncilstillconsidersthattheapplicant'sopinionsorcorrectionsdonotcomplywiththeprovisionslistedintheprecedingparagraph,theyshallberejected.Article45:Exceptforthepatentapplicationdocuments,anyotherdocumentsrelatedtothepatentapplicationsubmittedbytheapplicanttothepatentadministrativedepartmentundertheStateCouncilthatfallunderanyofthefollowingcircumstancesshallbedeemednottohavebeensubmitted:(1)Notusingtheprescribedformatorfillingoutinformationthatdoesnotcomplywithregulations;(2)Failuretosubmitproofmaterialsasrequired.ThepatentadministrativedepartmentoftheStateCouncilshallnotifytheapplicantoftheexaminationopinionsdeemednottohavebeensubmitted.Article46:Ifanapplicantrequeststheearlypublicationoftheirinventionpatentapplication,theyshalldeclareittothepatentadministrationdepartmentundertheStateCouncil.AfterthepreliminaryexaminationoftheapplicationbythepatentadministrationdepartmentoftheStateCouncil,unlessrejected,theapplicationshallbeimmediatelypublished.Article47:Iftheapplicantspecifiestheproductusingthedesignanditscategory,thedesignproductclassificationtablepublishedbythepatentadministrationdepartmentoftheStateCouncilshallbeused.Ifthecategoryoftheproductusingthedesignisnotspecifiedorthecategorywrittenisinaccurate,thepatentadministrationdepartmentoftheStateCouncilmaysupplementormodifyit.Article48:Fromthedateofpublicationofaninventionpatentapplicationtothedateofannouncementofthegrantofpatentrights,anypersonmaysubmitopinionstothepatentadministrativedepartmentoftheStateCouncilonpatentapplicationsthatdonotcomplywiththeprovisionsofthePatentLaw,andexplainthereasons.Article49:IfanapplicantforaninventionpatentisunabletosubmitthesearchmaterialsorexaminationresultmaterialsasstipulatedinArticle36ofthePatentLawduetojustifiablereasons,theyshalldeclaretothepatentadministrationdepartmentundertheStateCouncilandsubmittherelevantmaterialsafterobtainingthem.Article50:WhenthepatentadministrationdepartmentundertheStateCouncilconductsitsownexaminationofapatentapplicationinaccordancewiththeprovisionsofArticle35(2)ofthePatentLaw,itshallnotifytheapplicant.Article51:TheapplicantforaninventionpatentmayproactivelyproposeamendmentstotheinventionpatentapplicationwithinthreemonthsfromthedateofsubmittingarequestforsubstantiveexaminationandreceivinganotificationfromthepatentadministrationdepartmentundertheStateCouncilthattheinventionpatentapplicationhasenteredthesubstantiveexaminationstage.Theapplicantforautilitymodelordesignpatentmay,within2monthsfromthedateofapplication,proactivelyproposeamendmentstotheapplication.IftheapplicantmodifiesthepatentapplicationdocumentsafterreceivingtheexaminationopinionnotificationissuedbythepatentadministrativedepartmentoftheStateCouncil,theyshallmakemodificationstoaddressthedefectspointedoutinthenotification.ThepatentadministrativedepartmentoftheStateCouncilmaymodifyobviouserrorsinthetextandsymbolsinthepatentapplicationdocumentsonitsown.IfthepatentadministrativedepartmentoftheStateCouncilmakesmodificationsonitsown,itshallnotifytheapplicant.Article52:Forthemodifiedpartsofthespecificationorclaimsofaninventionorutilitymodelpatentapplication,exceptforindividualtextualmodificationsoradditionsordeletions,replacementpagesshallbesubmittedinaccordancewiththeprescribedformat.Themodificationofimagesorphotographsinadesignpatentapplicationshallbeaccompaniedbythesubmissionofreplacementpagesinaccordancewithregulations.Article53:AccordingtoArticle38ofthePatentLaw,thecircumstancesinwhichaninventionpatentapplicationshouldberejectedaftersubstantiveexaminationreferto:(1)TheapplicationfallsunderthecircumstancesstipulatedinArticle5orArticle25ofthePatentLaw,orcannotobtainpatentrightsinaccordancewithArticle9ofthePatentLaw;(2)TheapplicationdoesnotcomplywiththeprovisionsofArticle2(2),Article20(1),Article22,Article26(3),(4),(5),Article31(1)ofthePatentLaworArticle20(2)oftheseImplementingRegulations;(3)TheamendmentoftheapplicationdoesnotcomplywithArticle33ofthePatentLaw,orthedivisionalapplicationdoesnotcomplywiththeprovisionsofArticle43(1)oftheseImplementingRegulations.Article54:AfterthepatentadministrativedepartmentoftheStateCouncilissuesanoticetograntpatentrights,theapplicantshallcompletetheregistrationprocedureswithin2monthsfromthedateofreceiptofthenotice.Iftheapplicantcompletestheregistrationproceduresonschedule,thepatentadministrativedepartmentoftheStateCouncilshallgrantthepatentright,issuethepatentcertificate,andmakeapublicannouncement.Thosewhofailtocompletetheregistrationproceduresuponexpirationshallbedeemedtohavewaivedtheirrighttoobtainpatentrights.Article55:Ifnoreasonforrejectionisfoundafterexaminationofaconfidentialpatentapplication,thepatentadministrationdepartmentundertheStateCouncilshallmakeadecisiontogranttheconfidentialpatentright,issueaconfidentialpatentcertificate,andregisterrelevantmattersoftheconfidentialpatentright.Aftertheannouncementofthedecisiontograntautilitymodelordesignpatentright,thepatenteeorinterestedpartyasstipulatedinArticle60ofthePatentLawmayrequestthepatentadministrativedepartmentoftheStateCounciltomakeapatentevaluationreport.Ifrequestingapatentevaluationreport,arequestforapatentevaluationreportshallbesubmitted,specifyingthepatentnumber.Eachrequestshouldbelimitedtoonepatentright.Iftherequestforpatentevaluationreportdoesnotcomplywiththeregulations,thepatentadministrativedepartmentundertheStateCouncilshallnotifytherequestertomakecorrectionswithinaspecifiedtimelimit;Iftherequesterfailstomakecorrectionswithinthetimelimit,itshallbedeemedthattherequesthasnotbeenmade.Article57:ThepatentadministrationdepartmentundertheStateCouncilshallmakeapatentevaluationreportwithin2monthsafterreceivingtherequestforapatentevaluationreport.Ifmultipleclaimantsrequestapatentevaluationreportforthesameutilitymodelordesignpatent,thepatentadministrationdepartmentundertheStateCouncilshallonlyissueonepatentevaluationreport.Anyunitorindividualmayaccessorcopythepatentevaluationreport.Article58:ThepatentadministrationdepartmentundertheStateCouncilshallpromptlycorrectanyerrorsfoundinpatentannouncementsorpatentvolumes,andpublishthecorrectionsmade.Chapter4:ReexaminationofPatentApplicationsandInvalidationofPatentRightsArticle59:ThePatentReexaminationBoardshallbecomposedoftechnicalexpertsandlegalexpertsdesignatedbythepatentadministrationdepartmentoftheStateCouncil,andthechairmanshallbeconcurrentlyheldbythepersoninchargeofthepatentadministrationdepartmentoftheStateCouncil.Article60:IfarequestforreexaminationismadetothePatentReexaminationBoardinaccordancewithArticle41ofthePatentLaw,arequestforreexaminationshallbesubmitted,withreasonsexplainedandrelevantevidenceattachedifnecessary.IftherequestforreexaminationdoesnotcomplywiththeprovisionsofArticle19(1)orArticle41(1)ofthePatentLaw,thePatentReexaminationBoardshallnotacceptit,andshallnotifytherequesterinwritingandexplainthereasons.Iftherequestforreexaminationdoesnotconformtotheprescribedformat,therequestershallmakecorrectionswithinthetimelimitdesignatedbythePatentReexaminationBoard;Ifnocorrectionismadewithinthetimelimit,therequestforreexaminationshallbedeemednottohavebeenmade.Article61:TherequestermaymodifythepatentapplicationdocumentswhensubmittingarequestforreexaminationorrespondingtothereexaminationnoticeofthePatentReexaminationBoard;However,themodificationshouldbelimitedtoeliminatingthedefectspointedoutintherejectiondecisionorthenoticeofreexamination.Theamendedpatentapplicationdocumentsshallbesubmittedinduplicate.Article62:ThePatentReexaminationBoardshallforwardtheacceptedrequestforreexaminationtotheoriginalexaminationdepartmentoftheStateCouncil'spatentadministrationdepartmentforexamination.Iftheoriginalexaminationdepartmentagreestorevoketheoriginaldecisionbasedontherequestoftherequesterforreexamination,thePatentReexaminationBoardshallmakeareexaminationdecisionbasedonthisandnotifytherequesterforreexamination.Article63:IfthePatentReexaminationBoardfindsthattherequestforreexaminationdoesnotcomplywiththerelevantprovisionsofthePatentLawandtheseImplementingRegulationsafterreexamination,itshallnotifytherequesterandrequirethemtostatetheiropinionswithinaspecifiedperiodoftime.Ifthereisnoresponsewithinthedeadline,therequestforreexaminationshallbedeemedwithdrawn;If,afterpresentingopinionsormakingmodifications,thePatentReexaminationBoardconsidersthatitstilldoesnotcomplywiththerelevantprovisionsofthePatentLawandtheseImplementingRegulations,itshallmakeareexaminationdecisiontoupholdtheoriginalrejectiondecision.IfthePatentReexaminationBoardfindsthattheoriginalrejectiondecisiondoesnotcomplywiththerelevantprovisionsofthePatentLawandtheseImplementingRegulations,orifitconsidersthattheamendedpatentapplicationdocumentseliminatethedefectspointedoutintheoriginalrejectiondecision,theoriginalrejectiondecisionshallberevokedandtheoriginalexaminationdepartmentshallcontinuetheexaminationprocedure.Article64:BeforethePatentReexaminationBoardmakesadecision,therequesterforreexaminationmaywithdrawtheirrequestforreexamination.IftherequesterwithdrawstheirrequestforreexaminationbeforethePatentReexaminationBoardmakesadecision,thereexaminationprocedureshallbeterminated.Article65:IfarequestforinvalidationorpartialinvalidationofapatentrightismadeinaccordancewithArticle45ofthePatentLaw,arequestforinvalidationofthepatentrightandnecessaryevidenceinduplicateshallbesubmittedtothePatentReexaminationBoard.Therequestforinvalidationshallbeaccompaniedbyalltheevidencesubmitted,specifyingthereasonsfortheinvalidationrequestandindicatingtheevidenceonwhicheachreasonisbased.ThereasonfortheinvalidationrequestreferredtointheprecedingparagraphreferstothefactthattheinventionorcreationforwhichapatenthasbeengranteddoesnotcomplywiththeprovisionsofArticle2,Article20(1),Article22,Article23,Article26(3)and(4),Article27(2),Article33,orArticle20(2)andArticle43(1)oftheseImplementingRegulations,orfallsundertheprovisionsofArticle5orArticle25ofthePatentLaw,orcannotobtainapatentrightinaccordancewithArticle9ofthePatentLaw.Article66:IftherequestforinvalidationofapatentrightdoesnotcomplywiththeprovisionsofArticle19(1)ofthePatentLaworArticle65oftheseImplementingRegulations,thePatentReexaminationBoardshallnotacceptit.If,afterthePatentReexaminationBoardhasmadeadecisionontherequestforinvalidation,anotherrequestforinvalidationismadeonthesamegroundsandevidence,thePatentReexaminationBoardshallnotacceptit.IfarequestforinvalidationofadesignpatentismadeonthegroundsthatitdoesnotcomplywiththeprovisionsofArticle23(3)ofthePatentLaw,butnoevidenceissubmittedtoprovetheconflictofrights,thePatentReexaminationBoardshallnotacceptit.Iftherequestforinvalidationofapatentrightdoesnotconformtotheprescribedformat,thepersonrequestinginvalidationshallmakecorrectionswithinthetimelimitdesignatedbythePatentReexaminationBoard;Ifnocorrectionismadeuponexpiration,therequestforinvalidationshallbedeemednottohavebeenmade.Article67:AfterthePatentReexaminationBoardacceptsarequestforinvalidation,therequestermayaddreasonsorsupplementevidencewithinonemonthfromthedateoffilingtherequestforinvalidation.Ifthereareadditionalreasonsorsupplementaryevidencebeyondthedeadline,thePatentReexaminationBoardmaynotconsiderthem.Article68:ThePatentReexaminationBoardshallsendcopiesoftherequestforinvalidationofthepatentrightandrelevantdocumentstothepatentee,requestingthemtostatetheiropinionswithinaspecifiedtimelimit.ThepatenteeandthepersonrequestinginvalidationshallreplytothenoticeoftransferofdocumentsorthenoticeofexaminationofinvalidationrequestissuedbythePatentReexaminationBoardwithinthespecifiedtimelimit;Ifthereisnoresponsewithinthedeadline,itdoesnotaffectthereviewbythePatentReexaminationBoard.Article69:Duringtheexaminationprocessofarequestforinvalidation,thepatenteeofaninventionorutilitymodelpatentmaymodifyitsclaims,butshallnotexpandthescopeofprotectionoftheoriginalpatent.Thepatenteeofaninventionorutilitymodelpatentshallnotmodifythepatentspecificationanddrawings,andthepatenteeofadesignpatentshallnotmodifythedrawings,photographs,andbriefdescription.Article70:ThePatentReexaminationBoardmaydecidetoconductanoralhearingonarequestforinvalidationbasedontherequestofthepartiesortheneedsofthecase.IfthePatentReexaminationBoarddecidestoconductanoralhearingonarequestforinvalidation,itshallissueanoticeoforalhearingtotheparties,informingthemofthedateandplaceoftheoralhearing.Thepartiesshallrespondwithinthetimelimitspecifiedinthenotice.IftheapplicantforinvalidationfailstorespondtotheoralhearingnoticeissuedbythePatentReexaminationBoardwithinthespecifiedtimelimitanddoesnotparticipateintheoralhearing,theirinvalidationrequestshallbedeemedwithdrawn;Ifthepatenteedoesnotparticipateintheoralhearing,theymaybeabsentfromthehearing.Article71:Intheexaminationprocedureforinvalidationrequests,thedeadlinedesignatedbythePatentReexaminationBoardshallnotbeextended.Article72:BeforethePatentReexaminationBoardmakesadecisiononarequestforinvalidation,thepersonrequestinginvalidationmaywithdrawtheirrequest.IftheapplicantforinvalidationwithdrawstheirrequestortheirinvalidationrequestisdeemedwithdrawnbeforethedecisionofthePatentReexaminationBoard,theinvalidationrequestexaminationprocedureshallbeterminated.However,ifthePatentReexaminationBoardconsidersthatadecisiontodeclarethepatentrightinvalidorpartiallyinvalidcanbemadebasedontheexaminationworkalreadyconducted,theexaminationprocedureshallnotbeterminated.Chapter5CompulsoryLicenseforPatentImplementationArticle73:TheinsufficientimplementationofapatentreferredtoinArticle48(1)ofthePatentLawmeansthatthepatenteeanditslicenseeimplementthepatentinamanneroronascalethatdoesnotmeetthedomesticdemandforpatentedproductsormethods.ThedrugsthathaveobtainedpatentrightsreferredtoinArticle50ofthePatentLawrefertoanypatentedproductsinthefieldofmedicineorproductsdirectlyobtainedbypatentedmethodsnecessaryforsolvingpublichealthproblems,includingtheactiveingredientsrequiredformanufacturingthepatentedproductsandthediagnosticproductsrequiredforusingthepatentedproducts.Article74:Ifarequestforcompulsorylicenseismade,arequestforcompulsorylicenseshallbesubmittedtothepatentadministrationdepartmentundertheStateCouncil,explainingthereasonsandattachingrelevantsupportingdocuments.ThepatentadministrativedepartmentundertheStateCouncilshallsendacopyofthecompulsorylicenserequesttothepatentee,andthepatenteeshallstatetheiropinionswithinthetimelimitdesignatedbythepatentadministrativedepartmentundertheStateCouncil;Ifthereisnoresponsewithinthedeadline,itdoesnotaffectthedecisionmadebythepatentadministrativedepartmentoftheStateCouncil.Beforemakingadecisiontorejectarequestforcompulsorylicenseortograntacompulsorylicense,thepatentadministrativedepartmentoftheStateCouncilshallnotifytherequesterandthepatenteeoftheproposeddecisionanditsreasons.ThedecisionofgrantingcompulsorylicensebythepatentadministrationdepartmentoftheStateCouncilinaccordancewithArticle50ofthePatentLawshallalsocomplywiththeprovisionsofrelevantinternationaltreatiesconcludedoraccededtobyChinaongrantingcompulsorylicenseforthepurposeofsolvingpublichealthproblems,exceptwhereChinahasmadereservations.Article75:InaccordancewithArticle57ofthePatentLaw,ifapartyrequeststheStateCouncil'spatentadministrativedepartmenttomakearulingontheamountofroyalties,thepartyshallsubmitarequestforarulingandattachproofthatthetwopartiescannotreachanagreement.ThepatentadministrativedepartmentoftheStateCouncilshallmakearulingwithin3monthsfromthedateofreceiptoftherequestandnotifythepartiesconcerned.Chapter6:RewardsandRemunerationforInventorsorDesignersofServiceInventionsandCreationsArticle76:TheunitgrantedapatentrightmayagreewiththeinventorordesignerorstipulateinitsrulesandregulationsformulatedinaccordancewiththelawthemethodsandamountsofrewardsandremunerationasstipulatedinArticle16ofthePatentLaw.Therewardsandremunerationgivenbyenterprisesandinstitutionstoinventorsordesignersshallbehandledinaccordancewiththerelevantfinancialandaccountingregulationsofthestate.Article77:Iftheunitthathasbeengrantedapatentrighthasnotagreedwiththeinventorordesigner,norhasitstipulatedinitsrulesandregulationsformulatedinaccordancewiththelawthemethodandamountoftherewardprovidedforinArticle16ofthePatentLaw,itshallissueabonustotheinventorordesignerwithinthreemonthsfromthedateoftheannouncementofthepatentright.Theminimumbonusforaninventionpatentshallnotbelessthan3000yuan;Theminimumprizeforautilitymodelpatentordesignpatentshallnotbelessthan1000yuan.Theunittowhichthepatentrightisgrantedshallgiveabonustotheinventorordesignerfortheinventionorcreationcompletedbytheadoptionoftheirsuggestionsbytheiraffiliatedunit.Article78:Iftheunitgrantedthepatentrighthasnotagreedwiththeinventorordesigner,norhasitstipulatedinitsrulesandregulationsformulatedinaccordancewiththelawthemethodandamountofremunerationasstipulatedinArticle16ofthePatentLaw,duringthevalidityperiodofthepatentright,afterimplementingtheinventionorcreationpatent,itshallextractnolessthan2%oftheoperatingprofitfromimplementingtheinventionorutilitymodelpatentornolessthan0.2%oftheoperatingprofitfromimplementingthedesignpatenteachyearasremunerationtotheinventorordesigner,orgivetheinventorordesigneraone-timeremunerationbasedontheaboveproportion;Iftheunitgrantedthepatentrightlicensesotherunitsorindividualstoimplementitspatent,itshallextractnolessthan10%ofthecollectedusagefeeasremunerationandgiveittotheinventorordesigner.Chapter7ProtectionofPatentRightsArticle79:ThedepartmentresponsibleformanagingpatentworkreferredtointhePatentLawandtheseImplementingRegulationsreferstothedepartmentestablishedbythepeople'sgovernmentsofprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,aswellasthepeople'sgovernmentsofprefecturelevelcitieswithlargepatentmanagementworkloadsandactualprocessingcapabilitiestomanagepatentwork.Article80:ThepatentadministrativedepartmentoftheStateCouncilshallprovidebusinessguidancetothedepartmentsresponsibleformanagingpatentworkinhandlingpatentinfringementdisputes,investigatingandpunishingcounterfeitpatentacts,andmediatingpatentdisputes.Article81:Ifapartyrequeststohandleapatentinfringementdisputeormediateapatentdispute,itshallbeunderthejurisdictionofthedepartmentinchargeofpatentworkintheplacewheretherespondentislocatedorwheretheinfringementoccurred.Inpatentdisputeswheretwoormoredepartmentsresponsibleformanagingpatentworkhavejurisdiction,thepartiesmaymakearequesttooneofthedepartmentsresponsibleformanagingpatentwork;Ifapartymakesarequesttotwoormoredepartmentswithjurisdictionoverpatentwork,thedepartmentthatfirstacceptstherequestshallhavejurisdictionoverthepatentwork.Ifthereisadisputeoverjurisdictionamongthedepartmentsresponsibleformanagingpatentwork,thedepartmentresponsibleformanagingpatentworkundertheircommonsuperiorpeople'sgovernmentshalldesignatejurisdiction;Ifthereisnodepartmentofthepeople'sgovernmentwithacommonsuperiortomanagepatentwork,thepatentadministrativedepartmentoftheStateCouncilshalldesignatejurisdiction.Article82:Intheprocessofhandlingpatentinfringementdisputes,iftherespondentrequestsinvalidationandisacceptedbythePatentReexaminationBoard,theymayrequestthedepartmentinchargeofpatentworktosuspendthehandling.Ifthedepartmentresponsibleformanagingpatentworkconsidersthatthereasonsforsuspensionproposedbytherespondentareclearlyuntenable,theprocessingmaynotbesuspended.Article83:Ifthepatentee,inaccordancewithArticle17ofthePatentLaw,marksthepatentmarkonitspatentedproductoritspackaging,itshallbemarkedinthemannerprescribedbythepatentadministrationdepartmentundertheStateCouncil.Ifthepatentidentificationdoesnotcomplywiththeprovisionsoftheprecedingparagraph,thedepartmentinchargeofpatentmanagementshallordercorrection.Article84:ThefollowingactsconstitutetheactofcounterfeitingpatentsasstipulatedinArticle63ofthePatentLaw:(1)Labelingpatentmarksonproductsortheirpackagingthathavenotbeengrantedpatentrights,continuingtolabelpatentmarksonproductsortheirpackagingafterpatentrightsaredeclaredinvalidorterminated,orlabelingsomeoneelse'spatentnumberonproductsorproductpackagingwithoutpermission;(2)Selltheproductmentionedinitem(1);(3)Inproductmanualsandothermaterials,technologiesordesignsthathavenotbeengrantedpatentrightsarereferredtoaspatentedtechnologiesorpatenteddesigns,patentapplicationsarereferredtoaspatents,orothers'patentnumbersareusedwithoutpermission,causingthepublictomistaketheinvolvedtechnologiesordesignsforpatentedtechnologiesorpatenteddesigns;(4)Falsifyingoralteringpatentcertificates,patentdocuments,orpatentapplicationdocuments;(5)Otherbehaviorsthatconfusethepublicbymistakingtechnologyordesignsthathavenotbeengrantedpatentrightsaspatentedtechnologyorpatenteddesigns.Labelingpatentmarksonpatentedproducts,productsdirectlyobtainedthroughpatentedmethods,ortheirpackagingbeforetheterminationofpatentrights,andpromisingtosellorsellsuchproductsaftertheterminationofpatentrights,doesnotconstitutecounterfeitingofpatents.Sellingproductsthatarenotknowntobecounterfeitpatentsandcanprovethelegalsourceoftheproductshallbeorderedbythedepartmentinchargeofpatentmanagementtostopsales,butexemptedfromfines.Article85:ExceptasprovidedinArticle60ofthePatentLaw,thedepartmentresponsibleformanagingpatentworkmay,attherequestoftheparties,mediatethefollowingpatentdisputes:(1)Disputesoverpatentapplicationrightsandpatentownership;(2)Disputesoverthequalificationsofinventorsanddesigners;(3)Disputesoverrewardsandremunerationforinventorsanddesignersofjob-relatedinventionsandcreations;(4)Disputesarisingfromtheuseofaninventionwithoutpaymentofappropriatefeesafterthepublicationoftheinventionpatentapplicationandbeforethegrantofpatentrights;(5)Otherpatentdisputes.Forthedisputeslistedinitem(4)oftheprecedingparagraph,ifthepartiesrequestmediationfromthedepartmentinchargeofpatentwork,theyshallsubmititafterthepatentrightisgranted.Article86:Ifapartyhasadisputeovertheownershipofpatentapplicationrightsorpatentrightsandhasrequestedmediationfromthedepartmentinchargeofpatentworkorfiledalawsuitwiththepeople'scourt,theymayrequestthepatentadministrationdepartmentoftheStateCounciltosuspendtherelevantprocedures.Ifarequestismadetosuspendtherelevantproceduresinaccordancewiththeprovisionsoftheprecedingparagraph,arequestlettershallbesubmittedtothepatentadministrationdepartmentoftheStateCouncil,andacopyoftherelevantacceptancedocumentsindicatingtheapplicationnumberorpatentnumberfromthedepartmentorpeople'scourtresponsibleformanagingpatentworkshallbeattached.Afterthemediationagreementmadebythedepartmentinchargeofpatentworkorthejudgmentmadebythepeople'scourttakeseffect,thepartiesshallhandletheproceduresforrestoringtherelevantprocedureswiththepatentadministrativedepartmentoftheStateCouncil.Ifwithinoneyearfromthedateoftherequestforsuspension,disputesregardingtheownershipofpatentapplicationrightsorpatentrightscannotberesolvedandtherelevantproceduresneedtobecontinuedtobesuspended,therequestershallrequestanextensionofthesuspensionwithinthatperiod.Ifnoextensionisrequesteduponexpiration,thepatentadministrativedepartmentoftheStateCouncilshallrestoretherelevantproceduresonitsown.Article87:Ifapeople'scourtdecidestotakepreservationmeasuresforapatentapplicationrightorpatentrightinthetrialofacivilcase,thepatentadministrationdepartmentundertheStateCouncilshallsuspendtherelevantproceduresforthepreservedpatentapplicationrightorpatentrightonthedateofreceiptoftherulingindicatingtheapplicationnumberorpatentnumberandthenoticeofassistanceinenforcement.Ifthepreservationperiodexpiresandthepeople'scourtdoesnotruletocontinuetakingpreservationmeasures,thepatentadministrativedepartmentoftheStateCouncilshallrestoretherelevantproceduresonitsown.Article88:ThesuspensionofrelevantproceduresbythepatentadministrationdepartmentoftheStateCouncilinaccordancewithArticles86and87oftheseRulesreferstothesuspensionofthepreliminaryexamination,substantiveexamination,andreexaminationproceduresofpatentapplications,thegrantingofpatentrightsprocedures,andtheinvalidationproceduresofpatentrights;Suspendtheproceduresforwaiving,changing,transferringpatentrightsorpatentapplicationrights,patentpledgeprocedures,andterminationproceduresbeforetheexpirationofthepatentterm.Chapter8PatentRegistrationandPatentGazetteArticle89:TheStateCouncil'spatentadministrationdepartmentshallestablishapatentregistrationbooktoregisterthefollowingmattersrelatedtopatentapplicationsandpatentrights:(1)Grantofpatentrights;(2)Transferofpatentapplicationrightsandpatentrights;(3)Pledge,preservation,andreleaseofpatentrights;(4)Filingofpatentimplementationlicensecontracts;(5)Invalidationofpatentrights;(6)Terminationofpatentrights;(7)Restorationofpatentrights;(8)Compulsorylicenseforpatentimplementation;(9)Changesinthename,nationality,andaddressofthepatentee.Article90:ThepatentadministrationdepartmentoftheStateCouncilshallregularlypublishpatentbulletins,whichshallpublishorannouncethefollowingcontents:(1)Thebibliographicdataandabstractoftheinventionpatentapplication;(2)TherequestforsubstantiveexaminationofaninventionpatentapplicationandthedecisionofthepatentadministrativedepartmentundertheStateCounciltoconductsubstantiveexaminationoftheinventionpatentapplicationonitsown;(3)Therejection,withdrawal,deemedwithdrawal,deemedabandonment,restoration,andtransferofinventionpatentapplicationsafterpublication;(4)Thegrantofpatentrightsandthebibliographicdataofpatentrights;(5)Theabstractofthespecificationofaninventionorutilitymodelpatent,andapictureorphotographofadesignpatent;(6)Decryptionofnationaldefensepatentsandconfidentialpatents;(7)Invalidationofpatentrights;(8)Terminationandrestorationofpatentrights;(9)Transferofpatentrights;(10)Filingofpatentimplementationlicensecontracts;(11)Pledge,preservation,andreleaseofpatentrights;(12)Thegrantingofcompulsorylicenseforpatentimplementation;(13)Changeofthenameoraddressofthepatentee;(14)Announcementanddeliveryofdocuments;(15)CorrectionsmadebythepatentadministrativedepartmentoftheStateCouncil;(16)Otherrelatedmatters.Article91:ThepatentadministrationdepartmentundertheStateCouncilshallprovidepatentbulletins,volumesofinventionpatentapplications,andvolumesofinventionpatents,utilitymodelpatents,anddesignpatentsforfreepublicaccess.Article92:ThepatentadministrationdepartmentoftheStateCouncilshallberesponsibleforexchangingpatentdocumentswithpatentofficesorregionalpatentorganizationsofothercountriesorregionsinaccordancewiththeprincipleofreciprocity.Chapter9ExpensesArticle93:WhenapplyingforapatentandhandlingotherprocedureswiththepatentadministrationdepartmentoftheStateCouncil,thefollowingfeesshallbepaid:(1)Applicationfee,applicationsurcharge,publicationprintingfee,priorityclaimfee;(2)Substantiveexaminationfeeandreexaminationfeeforinventionpatentapplication;(3)Patentregistrationfee,announcementprintingfee,annualfee;(4)Restorationofrightsrequestfee,extensionofdeadlinerequestfee;(5)Feesforchangesinbibliographicdata,requestsforpatentevaluationreports,andrequestsforinvalidation.ThepaymentstandardsforthevariousfeeslistedintheprecedingparagraphshallbeformulatedbythepricemanagementdepartmentandthefinancedepartmentoftheStateCouncilinconjunctionwiththepatentadministrationdepartmentoftheStateCouncil.Article94:ThevariousfeesprescribedinthePatentLawandtheseImplementingRegulationsmaybepaiddirectlytothepatentadministrationdepartmentundertheStateCouncil,ormayberemittedthroughpostofficeorbank,orpaidinotherwaysprescribedbythepatentadministrationdepartmentundertheStateCouncil.Ifpaymentismadethroughpostofficeorbanktransfer,thecorrectapplicationnumberorpatentnumberandthenameofthefeepaidshallbeindicatedontheremittanceformsubmittedtothepatentadministrativedepartmentoftheStateCouncil.Thosewhodonotcomplywiththeprovisionsofthisclauseshallbedeemedasnothavingcompletedthepaymentprocedures.ForthosewhodirectlypayfeestothepatentadministrativedepartmentoftheStateCouncil,thepaymentdateshallbedeemedasthepaymentdate;Forfeespaidbypostalremittance,thepaymentdateshallbethepostmarkdateofthepostalremittance;Forfeespaidbybankremittance,theactualremittancedateofthebankshallbeconsideredasthepaymentdate.Ifthepatentfeeisoverpaid,overpaid,orincorrectlypaid,thepartyconcernedmayrequestarefundfromthepatentadministrationdepartmentoftheStateCouncilwithin3yearsfromthedateofpayment,andthepatentadministrationdepartmentoftheStateCouncilshallrefundit.Article95:Theapplicantshallpaytheapplicationfee,publicationprintingfee,andnecessaryapplicationsurchargeswithin2monthsfromthedateofapplicationorwithin15daysfromthedateofreceiptoftheacceptancenotice;Ifthepaymentisnotmadeorfullypaiduponexpiration,theapplicationshallbedeemedwithdrawn.Iftheapplicantrequestspriority,theyshallpaythepriorityclaimfeeatthesametimeaspayingtheapplicationfee;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatpriorityhasnotbeenclaimed.Article96:Ifapartyrequestssubstantiveexaminationorreexamination,theyshallpaythefeeswithintherelevanttimelimitstipulatedinthePatentLawandtheseImplementingRegulations;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatnorequesthasbeenmade.Article97:Whentheapplicantcompletestheregistrationprocedures,theyshallpaythepatentregistrationfee,announcementprintingfee,andannualfeefortheyearinwhichthepatentrightisgranted;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthattheregistrationprocedureshavenotbeencompleted.Article98:Theannualfeeafterthegrantofpatentrightsshallbepaidbeforetheexpirationofthepreviousyear.Ifthepatenteefailstopayorfailstopayinfull,thepatentadministrativedepartmentundertheStateCouncilshallnotifythepatenteetomakeupthepaymentwithin6monthsfromtheexpirationoftheannualfeedue,andatthesametimepayalatefee;Theamountoflatefeesshallbecalculatedbasedonanadditional5%ofthefullannualfeeforeachmonthbeyondtheprescribedpaymentperiod;Iftheannualfeeisnotpaiduponexpiration,thepatentrightshallterminatefromthedatewhentheannualfeedueisdue.Article99:Thefeeforrequestingtherestorationofrightsshallbepaidwithintherelevanttimelimitstipulatedinthesedetailedrules;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatnorequesthasbeenmade.Thefeeforrequestinganextensionofthedeadlineshallbepaidbeforethecorrespondingdeadlineexpires;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatnorequesthasbeenmade.Thefeesforchangesinbibliographicdata,requestsforpatentevaluationreports,andrequestsforinvalidationshallbepaidwithinonemonthfromthedateoftherequest;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatnorequesthasbeenmade.Article100:IftheapplicantorpatenteehasdifficultiesinpayingthevariousfeesprescribedintheseRegulations,theymaysubmitarequesttothepatentadministrationdepartmentundertheStateCouncilforreductionorpostponementofpaymentinaccordancewiththeregulations.ThemethodsforreducingordeferringpaymentsshallbeformulatedbythefinancialdepartmentoftheStateCouncilinconjunctionwiththepricemanagementdepartmentandthepatentadministrationdepartmentoftheStateCouncil.Chapter10SpecialProvisionsonInternationalApplicationsArticle101:ThepatentadministrationdepartmentundertheStateCouncilshall,inaccordancewithArticle20ofthePatentLaw,acceptinternationalpatentapplicationsfiledinaccordancewiththePatentCooperationTreaty.Theconditionsandproceduresforinternationalpatentapplications(hereinafterreferredtoasinternationalapplications)filedanddesignatedinChinaunderthePatentCooperationTreatytoentertheprocessingstageoftheStateCouncil'spatentadministrativedepartment(hereinafterreferredtoasenteringtheChinesenationalstage)shallbesubjecttotheprovisionsofthischapter;Iftherearenoprovisionsinthischapter,therelevantprovisionsofthePatentLawandotherchaptersoftheserulesshallapply.Article102:InternationalapplicationsforwhichtheinternationalapplicationdatehasbeendeterminedandChinahasbeendesignatedinaccordancewiththePatentCooperationTreatyshallbedeemedaspatentapplicationsfiledwiththepatentadministrationdepartmentundertheStateCouncil,andtheinternationalapplicationdateshallbedeemedastheapplicationdatereferredtoinArticle28ofthePatentLaw.Article103:Theapplicantofaninternationalapplicationshall,within30monthsfromtheprioritydatereferredtoinArticle2ofthePatentCooperationTreaty(referredtoastheprioritydateinthischapter),completetheproceduresforenteringtheChinesenationalphasewiththepatentadministrationdepartmentundertheStateCouncil;Iftheapplicantfailstocompletetheprocedureswithinthedeadline,afterpayingthegracefee,theymaycompletetheproceduresforenteringtheChinesenationalphasewithin32monthsfromtheprioritydate.Article104:IftheapplicantcompletestheproceduresforenteringtheChinesenationalphaseinaccordancewithArticle103oftheseRules,theyshallmeetthefollowingrequirements:(1)SubmitawrittendeclarationinChineseforenteringtheChinesenationalphase,specifyingtheinternationalapplicationnumberandthetypeofpatentrightsrequiredtobeobtained;(2)PaytheapplicationfeeandpublicationprintingfeeasstipulatedinArticle93(1)ofthesedetailedrules,andifnecessary,paythegracefeeasstipulatedinArticle103ofthesedetailedrules;(3)Iftheinternationalapplicationisfiledinaforeignlanguage,submittheChinesetranslationofthespecificationandclaimsoftheoriginalinternationalapplication;(4)InthewrittendeclarationenteringtheChinesenationalphase,thenameoftheinventionorcreation,thenameoraddressoftheapplicant,andthenameoftheinventorshallbespecified,andtheabovecontentshallbeconsistentwiththerecordsoftheInternationalBureauoftheWorldIntellectualPropertyOrganization(hereinafterreferredtoastheInternationalBureau);Iftheinventorisnotspecifiedintheinternationalapplication,thenameoftheinventorshallbestatedintheabovedeclaration;(5)Ifaninternationalapplicationisfiledinaforeignlanguage,theChinesetranslationoftheabstractshallbesubmitted.Iftherearedrawingsandabstractdrawings,copiesofthedrawingsandabstractdrawingsshallbesubmitted.Iftherearetextinthedrawings,theyshallbereplacedwiththecorrespondingChinesetext;ForinternationalapplicationssubmittedinChinese,submitcopiesoftheabstractanditsaccompanyingdrawingsintheinternationalpublicationdocuments;(6)ForthosewhohavecompletedtheapplicantchangeprocedureswiththeInternationalBureauintheinternationalphase,provideproofoftheapplicant'srighttoapplyafterthechange;(7)Whennecessary,paytheapplicationsurchargeasstipulatedinArticle93,Paragraph1ofthesedetailedrules.Forapplicationsthatmeettherequirementsofitems(1)to(3)ofthefirstparagraphofthisarticle,thepatentadministrationdepartmentundertheStateCouncilshallprovideanapplicationnumber,specifythedateonwhichtheinternationalapplicationenteredtheChinesenationalphase(hereinafterreferredtoastheentrydate),andnotifytheapplicantthattheirinternationalapplicationhasenteredtheChinesenationalphase.IfaninternationalapplicationhasenteredtheChinesenationalphasebutdoesnotmeettherequirementsofitems(4)to(7)ofparagraph1ofthisarticle,thepatentadministrationdepartmentundertheStateCouncilshallnotifytheapplicanttomakecorrectionswithinaspecifiedtimelimit;Ifnocorrectionismadewithinthetimelimit,theapplicationshallbedeemedwithdrawn.Article105:Ifaninternationalapplicationfallsunderanyofthefollowingcircumstances,itsvalidityinChinashallterminate:(1)Intheinternationalphase,iftheinternationalapplicationiswithdrawnordeemedwithdrawn,orifthedesignationofChinaintheinternationalapplicationiswithdrawn;(2)TheapplicantfailstocompletetheproceduresforenteringtheChinesenationalphaseinaccordancewithArticle103oftheseRuleswithin32monthsfromtheprioritydate;(3)TheapplicanthascompletedtheproceduresforenteringtheChinesenationalphase,butstilldoesnotmeettherequirementsofArticle104(1)to(3)oftheseRulesaftertheexpirationofthe32monthperiodfromtheprioritydate.Accordingtotheprovisionsofitem(1)oftheprecedingparagraph,iftheeffectivenessofaninternationalapplicationinChinaisterminated,theprovisionsofArticle6oftheseRegulationsshallnotapply;Accordingtotheprovisionsofitems(2)and(3)oftheprecedingparagraph,iftheeffectivenessofaninternationalapplicationinChinaisterminated,theprovisionsofArticle6,paragraph2oftheseRulesshallnotapply.Article106:Ifaninternationalapplicationhasbeenamendedduringtheinternationalphaseandtheapplicantrequestsexaminationbasedontheamendedapplicationdocuments,theChinesetranslationoftheamendedpartsshallbesubmittedwithin2monthsfromthedateofentry.IftheChinesetranslationisnotsubmittedduringthisperiod,thepatentadministrationdepartmentoftheStateCouncilwillnotconsiderthemodificationsproposedbytheapplicantintheinternationalphase.Article107:IftheinventionorcreationinvolvedinaninternationalapplicationfallsunderanyofthecircumstanceslistedinArticle24(1)or(2)ofthePatentLawandadeclarationwasmadeatthetimeoffilingtheinternationalapplication,theapplicantshallexplainitinthewrittendeclarationofenteringtheChinesenationalphaseandsubmittherelevantsupportingdocumentsasstipulatedinArticle30(3)oftheseImplementingRegulationswithin2monthsfromthedateofentry;Ifnoexplanationisprovidedornosupportingdocumentsaresubmittedwithintheprescribedperiod,theapplicationshallnotbesubjecttotheprovisionsofArticle24ofthePatentLaw.Article108:IftheapplicanthasprovidedexplanationsforthepreservationofbiologicalmaterialsamplesinaccordancewiththeprovisionsofthePatentCooperationTreaty,itshallbedeemedthattherequirementsofArticle24(3)oftheseImplementingRegulationshavebeenmet.TheapplicantshallindicateinthedeclarationofenteringtheChinesenationalphasethedocumentsthatrecordthepreservationofbiologicalmaterialsamplesandthespecificlocationoftherecordsinthedocuments.Iftheapplicanthasalreadyrecordedthepreservationofbiologicalmaterialsamplesinthespecificationoftheoriginalsubmittedinternationalapplication,buthasnotindicateditinthedeclarationofenteringtheChinesenationalphase,itshallbecorrectedwithin4monthsfromthedateofentry.Ifnocorrectionismadeuponexpiration,thebiologicalmaterialshallbedeemednottohavebeensubmittedforpreservation.IftheapplicantsubmitsthecertificateofpreservationandsurvivalofbiologicalmaterialsamplestothepatentadministrativedepartmentoftheStateCouncilwithin4monthsfromthedateofentry,itshallbedeemedtohavebeensubmittedwithinthetimelimitstipulatedinArticle24(1)oftheseRules.Article109:Iftheinventionorcreationinvolvedinaninternationalapplicationreliesongeneticresources,theapplicantshallprovideanexplanationinthewrittendeclarationoftheentryoftheinternationalapplicationintotheChinesenationalphaseandfillintheformformulatedbythepatentadministrationdepartmentoftheStateCouncil.Article110:IftheapplicanthasclaimedoneormorepriorityrightsintheinternationalphaseandthepriorityclaimcontinuestobevalidwhenenteringtheChinesenationalphase,itshallbedeemedthatawrittendeclarationhasbeenmadeinaccordancewithArticle30ofthePatentLaw.Theapplicantshallpaythepriorityclaimfeewithin2monthsfromthedateofentry;Ifthepaymentisnotmadeorfullypaiduponexpiration,itshallbedeemedthatthepriorityrighthasnotbeenclaimed.IftheapplicanthasalreadysubmittedacopyofthepriorapplicationdocumentinaccordancewiththeprovisionsofthePatentCooperationTreatyduringtheinternationalphase,thereisnoneedtosubmitacopyofthepriorapplicationdocumenttothepatentadministrativedepartmentoftheStateCouncilwhenhandlingtheproceduresforenteringtheChinesenationalphase.Iftheapplicantfailstosubmitacopyofthepriorapplicationdocumentsintheinternationalphase,thepatentadministrationdepartmentundertheStateCouncilmay,ifdeemednecessary,notifytheapplicanttosubmititwithinaspecifiedtimelimit;Iftheapplicantfailstomakeuptheoverduepayment,theirpriorityclaimshallbedeemednottohavebeenmade.Article111:IftheapplicantrequeststhepatentadministrationdepartmentundertheStateCounciltoprocessandexamineaninternationalapplicationinadvancebeforetheexpirationof30monthsfromtheprioritydate,inadditiontocompletingtheproceduresforenteringtheChinesenationalphase,theapplicantshallalsomakearequestinaccordancewithArticle23(2)ofthePatentCooperationTreaty.IftheInternationalBureauhasnotyettransmittedtheinternationalapplicationtothePatentAdministrationDepartmentoftheStateCouncil,theapplicantshallsubmitaconfirmedcopyoftheinternationalapplication.Article112:Forinternationalapplicationsseekingutilitymodelpatentrights,theapplicantmayproactivelyproposeamendmentstothepatentapplicationdocumentswithin2monthsfromthedateofentry.TheprovisionsofArticle51(1)oftheseImplementingRegulationsshallapplytointernationalapplicationsforobtaininginventionpatentrights.Article113:IftheapplicantdiscoverserrorsintheChinesetranslationofthetextinthesubmittedspecification,claimsordrawings,theymaymakecorrectionsinaccordancewiththeoriginalinternationalapplicationtextwithinthefollowingprescribedtimelimits:(1)BeforethepatentadministrationdepartmentoftheStateCouncilpreparesforthepublicationofinventionpatentapplicationsorutilitymodelpatentrights;(2)Within3monthsfromthedateofreceivingthenotificationfromthepatentadministrationdepartmentoftheStateCouncilthattheinventionpatentapplicationhasenteredthesubstantiveexaminationstage.Iftheapplicantcorrectstranslationerrors,theyshallsubmitawrittenrequestandpaytheprescribedtranslationcorrectionfee.IftheapplicantcorrectsthetranslationinaccordancewiththerequirementsofthenoticefromthepatentadministrationdepartmentoftheStateCouncil,theyshallcompletetheproceduresstipulatedinthesecondparagraphofthisarticlewithinthedesignatedtimelimit;Iftheprescribedproceduresarenotcompleteduponexpiration,theapplicationshallbedeemedwithdrawn.Article114:Forinternationalapplicationsseekinginventionpatentrights,ifthepatentadministrationdepartmentundertheStateCouncil,afterpreliminaryexamination,deemsthattheycomplywiththerelevantprovisionsofthePatentLawandtheseImplementingRegulations,theyshallbepublishedinthePatentGazette;IfaninternationalapplicationisfiledinalanguageotherthanChinese,theChinesetranslationoftheapplicationdocumentsshallbepublished.IfaninternationalapplicationforaninventionpatentispublishedinChinesebytheInternationalBureau,theprovisionsofArticle13ofthePatentLawshallapplyfromthedateofinternationalpublication;ForinternationalpublicationsmadebytheInternationalBureauinlanguagesotherthanChinese,theprovisionsofArticle13ofthePatentLawshallapplyfromthedateofpublicationbythepatentadministrationdepartmentundertheStateCouncil.Forinternationalapplications,thepublicationreferredtoinArticles21and22ofthePatentLawreferstothepublicationspecifiedinthefirstparagraphofthisArticle.Article115:Ifaninternationalapplicationcontainstwoormoreinventionsorutilitymodels,theapplicantmay,fromthedateofentry,fileadivisionalapplicationinaccordancewiththeprovisionsofArticle42,paragraph1oftheseImplementingRegulations.Intheinternationalphase,iftheinternationalsearchunitorinternationalpreliminaryexaminationunitconsidersthattheinternationalapplicationdoesnotmeettherequirementofunityasstipulatedinthePatentCooperationTreaty,andtheapplicantfailstopaytheadditionalfeeasrequired,resultingincertainpartsoftheinternationalapplicationnotundergoinginternationalsearchorinternationalpreliminaryexamination,whenenteringtheChinesenationalphase,theapplicantrequeststhatthesaidpartsbeusedasthebasisforexamination.IfthepatentadministrationdepartmentoftheStateCouncilconsidersthattheinternationalsearchunitorinternationalpreliminaryexaminationunithascorrectlyjudgedtheunityoftheinvention,itshallnotifytheapplicanttopaytheunityrestorationfeewithinaspecifiedperiodoftime.Ifthepaymentisnotmadeorfullypaiduponexpiration,theportionoftheinternationalapplicationthathasnotbeensearchedorhasnotundergoneinternationalpreliminaryexaminationshallbedeemedwithdrawn.Article116:Ifaninternationalapplicationisrefusedaninternationalfilingdateordeclaredwithdrawnbyarelevantinternationalauthorityintheinternationalphase,theapplicantmay,within2monthsfromthedateofreceiptofthenotification,requesttheInternationalBureautotransferacopyofanydocumentintheinternationalapplicationfiletothepatentadministrationdepartmentundertheStateCouncil,andwithinthisperiod,completetheproceduresprescribedinArticle103oftheseImplementingRegulationswiththepatentadministrationdepartmentundertheStateCouncil.ThepatentadministrationdepartmentundertheStateCouncilshall,uponreceivingthedocumenttransmittedbytheInternationalBureau,reviewwhetherthedecisionmadebytheinternationalauthorityiscorrect.Article117:IfthescopeofprotectiondeterminedinaccordancewithArticle59ofthePatentLawforapatentrightgrantedbasedonaninternationalapplicationexceedsthescopeexpressedintheoriginaltextoftheinternationalapplicationduetotranslationerrors,thelimitedscopeofprotectionbasedontheoriginaltextshallprevail;Ifthescopeofprotectionissmallerthanthescopeexpressedintheoriginaltextoftheinternationalapplication,thescopeofprotectionatthetimeofauthorizationshallprevail.Chapter11SupplementaryProvisionsArticle118:WiththeconsentofthepatentadministrationdepartmentundertheStateCouncil,anyonemayconsultorcopythecasefilesandpatentregistrationbooksofpatentapplicationsthathavebeenpublishedorannounced,andmayrequestthepatentadministrationdepartmentundertheStateCounciltoissueacopyofthepatentregistrationbook.Thecasefilesofpatentapplicationsthathavebeendeemedwithdrawn,rejected,orvoluntarilywithdrawnshallnotbepreservedafter2yearsfromthedateofexpirationofthepatentapplication.Thecasefilesofpatentrightsthathavebeenabandoned,declaredcompletelyinvalid,orterminatedshallnotbepreservedafter3yearsfromthedateofexpirationofthepatentrights.Article119:WhensubmittingapplicationdocumentsorhandlingvariousprocedurestothepatentadministrationdepartmentundertheStateCouncil,theapplicant,patentee,otherinterestedparties,ortheirrepresentativesshallsignoraffixtheirseals;Ifapatentagencyisentrusted,itshallbestampedbythepatentagency.Ifarequestismadetochangethenameoftheinventor,thenameortitle,nationalityandaddressofthepatentapplicantandpatentee,thenameandaddressofthepatentagency,andthenameoftheagent,theproceduresforchangingtherecordeditemsshallbehandledwiththepatentadministrativedepartmentoftheStateCouncil,andproofmaterialsofthereasonsforthechangeshallbeattached.Article120:WhenmailingdocumentsrelatedtoapplicationsorpatentrightstothepatentadministrativedepartmentundertheStateCouncil,registeredlettersshallbeusedandparcelsshallnotbeused.Exceptfortheinitialsubmissionofpatentapplicationdocuments,whensubmittingvariousdocumentsorhandlingvariousprocedurestothepatentadministrativedepartmentoftheStateCouncil,theapplicationnumberorpatentnumber,thenameoftheinventionorcreation,andthenameortitleoftheapplicantorpatenteeshallbeindicated.Alettershouldonlyincludedocumentsrelatedtothesameapplication.Article121:Alltypesofapplicationdocumentsshallbetypedorprinted,withblackhandwriting,neatandclear,andshallnotbealtered.Theattacheddrawingsshouldbedrawnusingdrawingtoolsandblackink,andthelinesshouldbeuniformandclear,andshouldnotbealtered.Therequest,specification,claims,drawings,andabstractshallbenumberedsequentiallyinArabicnumerals.Thetextpartoftheapplicationdocumentshouldbewrittenhorizontally.Paperislimitedtosingle-sideduse.Article122:ThepatentadministrationdepartmentundertheStateCouncilshallformulateguidelinesforpatentexaminationinaccordancewiththePatentLawandtheseImplementingRegulations.Article123:ThesedetailedrulesshallcomeintoeffectonJuly1,2001.TheImplementingRegulationsofthePatentLawofthePeople'sRepublicofChina,approvedforrevisionbytheStateCouncilonDecember12,1992andissuedbytheChinesePatentOfficeonDecember21,1992,aresimultaneouslyabolished.
